Administrative Review Tribunal Substitutes Five-Year Suspension for Cancellation of Liquidator Richard Ernest Auricht's Registration
The Administrative Review Tribunal (ART) overturned the Registered Liquidator Disciplinary Committee's decision to cancel Richard Ernest Auricht's registration, substituting it with a five-year suspension commencing on 23 June 2023. The Tribunal upheld findings that Auricht drew remuneration without approval, failed to lodge documents with ASIC, and lacked the necessary capacity to act as a liquidator. ASIC has implemented the suspension, noting that while Auricht's conduct involved serious breaches, it did not involve dishonesty or prior disciplinary history.
