Full Federal Court dismisses Latitude and Harvey Norman appeals over misleading advertising

ASIC initiated proceedings against Latitude Finance Australia and Harvey Norman Holdings for breaches of consumer law regarding a national advertising campaign that failed to disclose mandatory credit card requirements and associated fees. The Full Federal Court unanimously dismissed the companies' appeals, upholding the trial judge's finding that the promotional message was misleading because it concealed material conditions such as establishment and monthly account service fees. The matter will proceed to a hearing where ASIC seeks pecuniary penalties, adverse publicity orders, an injunction, and costs.
