System for Reporting International Transaction Data

The Governor of the Central Bank of Lebanon,

Pursuant to the Monetary and Discount Law, particularly Articles 146 and 179 thereof,

Pursuant to Law No. 160 dated 1999/12/27 regarding the regulation of leasing operations, particularly Article 20 thereof,

Pursuant to Law No. 234 dated 2000/6/10 regarding the regulation of the financial intermediary profession, particularly Article 10 thereof,

Pursuant to Basic Decision No. 6170 dated 1996/5/17 regarding the definition of "Resident and Non-Resident" in Lebanon and the classification of accounts, operations, and statistics based on it,

Pursuant to the decision of the Central Council of the Central Bank of Lebanon taken in its meeting held on 9 January 2002,

Decides as follows:

Article 1: All banks, financial institutions, financial intermediaries, and leasing companies must classify every payment or receipt operation equivalent to or exceeding $10,000 (ten thousand US dollars) according to its economic purpose (tourism, purchase of goods, investment, transport, etc.), as indicated in the "Codes Used in Classifying Transactions Recorded in the Balance of Payments" table attached to this decision, and according to the concept of residence defined in the regulations issued by the Central Bank of Lebanon.

Article 2: All banks must declare quarterly the operations mentioned in Article 1 above, according to Questionnaires "A" and "B" included in Form -3ITRS listed in the project for electronic transmission of statistical reports STR-e, based on the "Interpretive Guide for the System for Reporting International Transaction Data" and the "List of Country Names according to Geographic Classification" attached to this decision.

Article 3: All banks must provide the Economics Department at the Central Bank of Lebanon, via the project for electronic transmission of statistical reports STR-e, with the Form -3ITRS mentioned in Article 2 above and the "Respondent Identification Form" attached to this decision, within a period of one month following the end of each quarter.

Article 4: Institutions that do not comply with the provisions of this decision are subject to the administrative penalties stipulated in Article 208 of the Monetary and Discount Law.

Article 5: This decision shall take effect upon its issuance.

Article 6: This decision shall be published in the Official Gazette.

Chapter One: General Introduction

1-1 Definition of the System for Reporting International Transaction Data

The System for Reporting International Transaction Data is one of the most important statistical tools for providing detailed statistics for the balance of payments. It is based on classifying the nature of capital flows to and from the Lebanese economy according to their economic purpose.

2-1 Scope of the Survey

The survey covers all transactions conducted between a resident entity and a non-resident entity through the banking and financial sector in Lebanon. Consequently, the entities covered by the survey are: -1 Commercial Banks. -2 Specialized Banks.

As for financial institutions, financial intermediaries, and leasing companies: They are not obliged to fill out the survey forms as they conduct their transactions through the banking sector; however, they are concerned by this circular as clients, and thus they must declare to the banks the economic reason for the transfer to facilitate the coding process.

3-1 Types of Questionnaires

Two types of questionnaires have been prepared, which every respondent must fill out:

• Questionnaire A, for transactions resulting in a financial flow to the Lebanese economy (receipts).
• Questionnaire B, for transactions resulting in a financial flow from the Lebanese economy (payments).

4-1 Level of Detail

For transactions equivalent to or exceeding $10,000 US dollars, the declaration must include: • The date of the transaction, • Its value, • The legal identity according to the concept of residence, • The sectoral classification of the entity benefiting from or issuing the transaction order (see the Sector Table), • The geographic classification of the non-resident banking sector (see the Geographic Classification Table and the List of Country Names according to Geographic Classification), • And the code used in the classification of balance of payments items (see the Codes Used in Classifying Transactions Recorded in the Balance of Payments table) which relates to the economic purpose of the transaction.

For transactions with a value less than $10,000 US dollars, which were conducted between the resident banking sector and the non-resident banking sector on resident accounts, the declaration must include: • The total number and value of transactions less than $2,000 US dollars, • The total number and value of transactions equivalent to or exceeding $2,000 US dollars and less than $10,000 US dollars, • The total number and value of transactions equivalent to or exceeding $10,000 US dollars.

Chapter Two: General Guidelines Regarding Declaration

1-2 Who fills out the questionnaires?

All resident entities belonging to the categories mentioned in paragraph 2-1 must declare the required information to the Central Bank of Lebanon (see paragraph 4-1).

2-2 What are the transactions that must be declared?

All resident entities belonging to the categories mentioned in paragraph 2-1 must declare two types of transactions, if the value of a single transaction equals or exceeds $10,000 US dollars: • Those conducted between the resident banking and financial sector and the non-resident banking and financial sector, • Those conducted between residents and non-residents to and from the banking and financial sector in Lebanon, provided that only the entity that moved the non-resident account declares these transactions.

And the entities concerned by the circular must adhere to the following:

• Classification: If the account is shared between a resident and a non-resident entity, the account is classified as resident. • Coding: If the transaction involves more than one capital movement and they cannot be separated, the entire transaction is coded according to the economic purpose of the largest value movement. • Declaration: o Do not declare transactions involving cash, cash boxes, or bank cards. o Do not declare money transfer transactions by exchange offices (value of funds). o Declare the cost of money transfers by exchange offices.

3-2 Valuation Rule

Only transactions equivalent to or exceeding $10,000 US dollars must be declared, from which those conducted between a resident entity and a non-resident entity are extracted, according to the concept defined in the regulations issued by the Central Bank of Lebanon (Basic Decision No. 6170 dated 1996/05/17 attached to Central Circular No. 24).

All amounts must be declared in their equivalent value in US dollars (in thousands), based on the exchange rates prevailing at the time of the transaction.
