The Governor of the Central Bank of Lesotho has issued the Money Laundering (Administrative Sanctions) Rules, 2023 to establish a formal administrative sanctions regime for accountable institutions supervised by the Bank. The Central Bank must issue a written notice detailing the intended sanction and the institution's right to show cause before imposing penalties, which must be paid within thirty days. The Rules empower regulators to remove directors or senior management, prohibit specific products or processes, restrict managerial decision-making, and mandate remedial plans, internal inquiries, or disciplinary actions to enforce compliance with the Money Laundering and Proceeds of Crime Act.

LEGAL NOTICE NO. 12 OF 2023 Money Laundering (Administrative Sanctions) Rules, 2023 Pursuant to sections 18B(1)(c) and 18D, of the Money Laundering and Proceeds of Crime Act, 2008 1 , I, EMMANUEL MALUKE LETETE being the Governor of the Central Bank, a financial sector supervisory authority, make the following Rules - Citation and commencement
88 (2) Where there are contradictions between these Rules and the Act and its implementing regulations, the Act and its implementing regulations shall apply. Procedure for imposing sanctions 5. Where the Central Bank intends to impose a sanction, it shall issue a written notice to an accountable institution indicating the - (a) right of the accountable institution to show cause why such sanctions may not be imposed on it; and (b) sanction that it intends to impose. Administrative sanctions 6. (1) The Central Bank may impose the following administrative sanctions upon an accountable institution for any contravention of the provisions of the Act, its implementing Regulations and these Rules: (a) direct that the members of the Board of Directors and senior management of the accountable institution be removed from their roles; (b) prohibit the accountable institution from providing or operating certain product or certain processes; (c) a temporary or permanent prohibition on any natural person who holds a managerial position in the accountable institution from taking decisions relating to the accountable institution; (d) direct the accountable institution to undertake any given actions to - (i) comply with the requirements within a specified period through a remedial plan; (ii) conduct internal inquiries and submit a report to the Central Bank; or
(iii) take disciplinary action against directors, senior management or other officers. (2) An accountable institution shall pay financial penalty imposed on it in terms of the Act within 30 days of its issuance. Amendment or repeal of the Rules 7.
