ACPR Compliance with EBA Guidelines on STS Criteria for On-Balance Sheet Securitizations (EBA/GL/2024/05)

The Prudential Control and Resolution Authority (ACPR) declares compliance with the European Banking Authority's Guidelines EBA/GL/2024/05 regarding STS criteria for on-balance sheet securitizations. These guidelines apply to securitizations created or issued after December 9, 2024, and target financial institutions subject to Regulation (EU) No 2017/2402. Affected entities are required to take all necessary measures to adhere to these orientations in accordance with Article 16 of Regulation (EU) No 1093/2010.

OPINION Compliance of the ACPR with the European Banking Authority's "EBA/GL/2024-05" Guidelines on STS Criteria for On-Balance Sheet Securitizations and Amending Guidelines EBA/GL/2018/08 and EBA/GL/2018/09 on STS Criteria for ABCP and Other Securitizations

The Prudential Control and Resolution Authority (ACPR) has declared itself compliant with the European Banking Authority's Guidelines EBA/GL/2024-05 of May 27, 2024, on STS criteria for on-balance sheet securitizations and amending Guidelines EBA/GL/2018/08 and EBA/GL/2018/09 on STS criteria for ABCP and other securitizations, which are annexed to this opinion.

These guidelines apply to on-balance sheet securitizations where the securitization positions are created in accordance with credit protection conventions adopted after December 9, 2024, and to securitizations where the securities are issued in accordance with agreement terms adopted after December 9, 2024. They address financial institutions referred to in Article 4, paragraph 1, of Regulation (EU) No 1093/2010, which are subject to regulation and supervision under Regulation (EU) No 2017/2402, including third parties verifying STS compliance also in accordance with the last subparagraph of Article 2, paragraph 5, of Regulation (EU) No 1093/2010. These entities must do everything in their power to comply with these guidelines, in accordance with the provisions of Article 16 of Regulation (EU) No 1093/2010 of the European Parliament and of the Council of November 24, 2010, establishing a European Supervisory Authority (European Banking Authority).
