FSCA Submission to Parliament of Amendments to the FAIS General Code of Conduct, Short-term Deposit Code and Fit and Proper Requirements

The Financial Sector Conduct Authority submitted draft amendments to Parliament on 18 February 2020, updating the FAIS General Code of Conduct, Short-term Deposit Code, and Fit and Proper Requirements. Each amendment package includes a draft notice, supporting statement, and consultation report prepared under section 103(1) of the Financial Sector Regulation Act. Stakeholders may access these regulatory instruments and related documentation on the FSCA website for review and further engagement.

1 FSCA Communication 3 of 2020 (FAIS) Submission to Parliament of Amendments to the FAIS General Code of Conduct, Short-term Deposit Code and Fit and Proper Requirements

The purpose of this Communication is to inform stakeholders that on 18 February 2020 the Financial Sector Conduct Authority (FSCA) submitted the following draft Amendments and supporting documents to Parliament in terms of section 103(1) of the Financial Sector Regulation Act, 2017 (Act No. 9 of 2017) (FSR Act): 1.1 Amendment of the General Code of Conduct for Authorised Financial Services Providers and Representatives, 2003 (General Code of Conduct) as well as the Specific Code of Conduct for Authorised Financial Services Providers and Representatives Conducting Short-term Deposit Business, 2004 (Short-term Deposit Code): • Draft amendment Notice of the General Code of Conduct and the Short-term Deposit Code; • Statement supporting the Amendment Notice; and • Consultation report on the Amendment Notice. 1.2 Amendment of the Determination of Fit and Proper Requirements for Financial Services Providers, 2017, (Fit and Proper requirements): • Draft amendment Notice of the Fit and Proper requirements; • Statement supporting the Amendment Notice; and • Consultation report on the Amendment Notice.
