Regulation on the Classification of Risk Types by Groups and Insurance or Reinsurance Types – Unofficial Consolidated Text (NN, No. 23/16, 27/16, 42/19, 142/22)

Issued by the Croatian regulatory authority, this Regulation establishes a standardized classification framework for risk types across insurance groups, subgroups, business lines, and specific insurance categories. It mandates that all licensed insurance and reinsurance companies apply this framework when obtaining operational approvals, reporting cross-border activities, and segmenting life and non-life liabilities according to the actual nature of underlying risks. The Regulation aligns domestic business lines with EU Regulation 2015/35 and provides detailed codified lists of accident, health, property, liability, financial loss, and life insurance risks to ensure consistent regulatory reporting and risk distribution.

Unofficial Consolidated Text (Official Gazette No. 23/2016, 27/2016, 42/2019, 142/2022) REGULATION ON THE CLASSIFICATION OF RISK TYPES BY GROUPS AND INSURANCE OR REINSURANCE TYPES INTRODUCTORY PROVISIONS Article 1. (1) This Regulation prescribes the classification of risk types by:

  • insurance groups,
  • subgroups of insurance,
  • business lines,
  • types of insurance within insurance groups. (2) The provisions of this Regulation apply mutatis mutandis to reinsurance companies. INSURANCE GROUPS Article 2. Insurance groups are: I. Non-life insurance, II. Life insurance. SUBGROUPS OF INSURANCE Article 3. (1) Subgroups of non-life insurance are used for: I. issuing approvals for conducting insurance and reinsurance activities if they simultaneously cover multiple types of insurance under Article 24 of the Insurance Act, II. reporting data on cross-border insurance activities conducted by an insurance company based on establishment and freedom to provide services under Article 202, paragraphs 3, 4, and 5 of the Insurance Act. (2) Subgroups of non-life insurance used for issuing approvals for conducting insurance and reinsurance activities, if they simultaneously cover multiple types or risks of insurance, include: a) accident and health insurance of the type under Article 5 of this Regulation listed as 01 and 02, b) motor vehicle insurance of the type or risk under Article 5 and Article 7 listed as: 01.02, 01.07, 03, 07 and 10, c) marine and transport insurance of the type or risk under Article 5 and Article 7 listed as: 01.07, 04, 06, 07, and 12, d) aircraft insurance of the type or risk under Article 5 and Article 7 listed as: 01.07, 05, 07 and 11, e) fire and other property insurance of the type under Article 5 listed as: 08 and 09, f) liability insurance of the type under Article 5 listed as: 10, 11, 12 and 13, g) credit insurance and guarantee insurance of the type under Article 5 listed as: 14 and 15, h) all types of non-life insurance under Article 5. (3) Subgroups of non-life insurance used for reporting data on cross-border insurance activities conducted by an insurance company based on establishment and freedom to provide services include: a) accident and sickness insurance of the type under Article 5 listed as 01 and 02, b) road vehicle insurance of the type under Article 5 listed as: 03, 07 and 10 (excluding carrier's liability which is listed separately), c) fire and other property insurance of the type under Article 5 listed as: 08 and 09, d) aircraft, marine and transport insurance of the type under Article 5 listed as: 04, 05, 06, 07, 11 and 12, e) other liability insurance of the type under Article 5 listed as 13, f) credit insurance and guarantee insurance of the type under Article 5 listed as: 14 and 15, g) other types of insurance under Article 5 listed as: 16, 17 and 18. BUSINESS LINES Article 4. (1) Business lines defined by Regulation (EU) No. 2015/35 are used when submitting information by insurance or reinsurance companies to the Agency and include the following types of insurance or risks within types of insurance: | Business Lines | Description | |---|---| | A. Non-life insurance liabilities || | 1. Medical expense insurance | Liabilities for medical expenses where the core activity is not provided on a technical basis similar to life insurance, except liabilities listed under business line 3. Covers risks from Article 7 listed as 02.02, 02.04, 02.06 and 02.99. | | 2. Income protection insurance | Liabilities for income protection where the core activity is not conducted on a technical basis similar to life insurance, except liabilities listed under business line 3. Covers risks from Article 7 listed as 01.01, 01.02, 01.03, 01.04, 01.05, 01.06, 01.07 and 01.99. | | 3. Workers' compensation insurance | Health insurance liabilities relating to workplace accidents and occupational diseases, where the core activity is not conducted on a technical basis similar to life insurance. Covers risk from Article 7 listed as 02.01. | | 4. Motor vehicle liability insurance | Liabilities including all types of liability arising from the use of motor vehicles operated on land (including carrier's liability). Covers risks from Article 7 listed as 10.01, 10.02, 10.03 and 10.99. | | 5. Other motor vehicle insurance | Liabilities including all damages or loss of land vehicles (including tracked vehicles). Covers risks from Article 7 listed as 03.01, 03.02, 03.99, 04.01 and 04.99. | | 6. Marine, aircraft and transport insurance | Liabilities including all damages or loss of vessels operated on sea, lake, river or in canals, aircraft, and damages or loss of cargo or luggage regardless of transport mode. Liabilities including all types of liability arising from the use of aircraft, sea, river and lake vessels, and canal navigation vessels (including carrier's liability). Covers risks from Article 7 listed as 05.01, 05.02, 05.99, 06.01, 06.02, 06.03, 06.04, 06.05, 06.99, 07.01, 07.02, 07.03, 07.04, 07.99, 11.01, 11.02, 11.99, 12.01, 12.02, 12.03 and 12.99. | | 7. Fire and other property insurance | Liabilities including all damages or loss of property except those listed in business lines 5 and 6 due to fire, explosion, natural disasters including storm, hail or freezing, atomic energy, soil sliding and other various events such as theft. Covers risks from Article 7 listed as 08.01, 08.02, 08.03, 08.99, 09.01, 09.02, 09.03, 09.04, 09.05, 09.06, 09.07, 09.08, 09.09, 09.10, 09.11, 09.12 and 09.99. | | 8. Other liability insurance | Liabilities including all types of liability except those in business lines 4 and 6. Covers risks from Article 7 listed as 13.01 through 13.22 and 13.99. | | 9. Credit insurance and guarantee insurance | Liabilities including insolvency, export credit, installment loans, mortgages, agricultural credit, and direct and indirect guarantees. Covers risks from Article 7 listed as 14.01, 14.02, 14.03, 14.99, 15.01, 15.02 and 15.99. | | 10. Legal expenses insurance | Liabilities including legal protection costs and court proceeding costs. Includes risk from Article 7 listed as 17.01 and 17.99. | | 11. Assistance (assistance) insurance | Liabilities including assistance to persons who encounter difficulties during travel, stay away from home or outside their usual residence. Covers risks from Article 7 listed as 18.01, 18.03, 18.04, 18.05 and 18.99. | | 12. Various financial loss insurance | Liabilities including professional risks, inadequate income, bad weather, lost profit, uninterrupted general expenses, unforeseen business expenses, loss of market value, loss of rent or income, indirect business losses except those listed above, other financial losses (non-business), and any other non-life insurance risk not covered by business lines 1 to 11. Covers risks from Article 7 listed as 16.01, 16.02, 16.03, 16.04, 16.05, 16.06 and 16.99. | | B. Proportional non-life reinsurance liabilities | Business lines 13 to 24 cover proportional reinsurance liabilities relating to liabilities listed in each of business lines 1 to 12. | | C. Health insurance | Liabilities for health insurance where the core activity is conducted on a technical basis similar to life insurance, except liabilities listed under business line 33. Covers risk from Article 8 listed as 19.05. | | 30. Participating insurance | Liabilities for participating insurance except those in business lines 33 and 34. Health reinsurance | Reinsurance liabilities relating to liabilities listed in business lines 29 and 33. | | 36. Life reinsurance | Reinsurance liabilities relating to liabilities listed in business lines 30 to 32 and 34. | (2) Exceptionally from paragraph 1, an insurance or reinsurance company may apply a different risk distribution by business lines in the case of determining (segmentation) life or non-life insurance liabilities according to the actual nature of the underlying risk. TYPES OF INSURANCE Article 5. Types of insurance within the Non-life Insurance group are divided into:
  1. accident insurance,
  2. health insurance,
  3. road vehicle insurance
  4. tracked vehicle insurance,
  5. aircraft insurance,
  6. vessel insurance,
  7. cargo in transit insurance,
  8. fire and elemental damage insurance,
  9. other property insurance,
  10. motor vehicle liability insurance,
  11. aircraft liability insurance,
  12. vessel liability insurance,
  13. other liability insurance,
  14. credit insurance,
  15. guarantee insurance,
  16. various financial loss insurance,
  17. legal expenses insurance,
  18. assistance (assistance) insurance. Article 6. Types of insurance within the Life Insurance group are divided into:
  19. life insurance,
  20. annuity insurance,
  21. supplementary life insurance,
  22. marriage or civil partnership or birth insurance
  23. life and annuity insurance where the policyholder bears investment risk,
  24. tontines,
  25. insurance with capitalization of payout. TYPES OF RISKS Article 7. Types of risks within non-life insurance types are divided into: 01 ACCIDENT INSURANCE includes workplace injuries and occupational diseases, covering the following:
  • fixed monetary benefits or payment of contracted monetary benefits,
  • indemnity-type benefits or reimbursement of costs,
  • combination of payments from the above items,
  • payouts for passenger injury, health impairment or death; covering: 01.01 Insurance of persons from the consequences of accidents inside and outside regular employment, 01.02 Insurance of persons from the consequences of accidents in motor vehicles and during special activities, 01.03 Insurance of children and school youth from the consequences of accidents and special insurance of youth from the consequences of accidents, 01.04 Insurance of guests, event visitors, excursionists and tourists from the consequences of accidents, 01.05 Insurance of consumers, subscribers, users of other public services and similar from the consequences of accidents, 01.06 Other special insurance from the consequences of accidents, 01.07 Mandatory passenger insurance in public transport from the consequences of accidents, 01.99 Other insurance from the consequences of accidents. 02 HEALTH INSURANCE is insurance that in case of illness, injuries and other accidental events covers:
  • fixed monetary benefits or payment of contracted monetary benefits,
  • indemnity-type benefits or reimbursement of treatment costs, medication and medical-technical aids costs,
  • combination of payments from the above items; covering: 02.01 Mandatory insurance of cost benefits for workplace injury and occupational disease, 02.02 Supplementary insurance of the difference above the value of health services covered by mandatory health insurance, 02.04 Additional health insurance with a broader scope and higher standard of healthcare coverage provided by mandatory health insurance, 02.06 Private health insurance, 02.99 Other voluntary health insurances. 03 ROAD VEHICLE INSURANCE, excluding tracked vehicles, is insurance that covers all damages or loss of:
  • land road vehicles with their own motor drive,
  • land road vehicles without their own drive; covering: 03.01 Hull insurance of self-propelled road motor vehicles, 03.02 Hull insurance of road vehicles without their own drive, 03.99 Other hull insurance of road vehicles. 04 TRACKED VEHICLE INSURANCE is insurance that covers all damages or loss of tracked vehicles; covering: 04.01 Hull insurance of tracked vehicles, 04.99 Other insurance of tracked vehicles. 05 AIRCRAFT INSURANCE is insurance that covers all damages or loss of aircraft, covering: 05.01 Hull insurance of heavier-than-air aircraft, 05.02 Hull insurance of lighter-than-air aircraft, 05.99 Other insurance of aircraft. 06 VESSEL INSURANCE is insurance that covers all damages or loss of sea, river, lake vessels and canal navigation vessels; covering: 06.01 Hull insurance of vessels in maritime navigation, 06.02 Hull insurance of vessels for canal and river navigation, 06.03 Hull insurance of vessels in lake navigation, 06.04 Hull insurance of ships under construction, 06.05 Hull insurance of platforms, 06.99 Other hull insurance of vessels. 07 CARGO IN TRANSIT INSURANCE is insurance that covers all damages or loss of cargo in transit or luggage and other goods, regardless of transport mode, covering: 07.01 Insurance of cargo in maritime transport, 07.02 Insurance of cargo in air transport, 07.03 Insurance of cargo in land transport, 07.04 Insurance of cargo during storage, 07.99 Other insurance of cargo in transit. 08 FIRE AND ELEMENTAL DAMAGE INSURANCE is insurance that covers all damages or loss of property except those listed under: 03, 04, 05, 06 and 07) resulting from the action of: fire, explosion, storm, elemental disasters except storm, atomic energy, soil sliding and other supplementary hazards, covering: 08.01 Insurance from fire and elemental disasters outside industry and crafts, 08.02 Insurance from fire and elemental disasters in industry and crafts, 08.03 Insurance from earthquakes, 08.99 Other insurance from fire and elemental disasters. 09 OTHER PROPERTY INSURANCE are insurances that cover all damages or loss of property except those from the types listed under: 03, 04, 05, 06 and 07 which occur as a result of hail or freezing as well as the consequences of any other event such as theft and other actions different from those listed under 08, covering: 09.01 Insurance of machinery against breakage, 09.02 Insurance against burglary and robbery, 09.03 Insurance of glass against breakage, 09.04 Household insurance, 09.05 Insurance of construction objects under construction, 09.06 Insurance of assembled objects, 09.07 Insurance of film activities, 09.08 Insurance of items in mine shafts, 09.09 Insurance of computer equipment, 09.10 Insurance of stock in cold stores, 09.11 Insurance of crops and plantations, 09.12 Insurance of animals, 09.99 Other insurance of property. 10 MOTOR VEHICLE LIABILITY INSURANCE is insurance that covers all types of liability arising from the use of land motor vehicles with their own drive including carrier's liability, covering: 10.01 Mandatory insurance of owners or users of motor vehicles against liability for damages to third parties, 10.02 Voluntary insurance of owners or users of motor vehicles against liability for damages to third parties, 10.03 Insurance against carrier's liability for cargo received for transport in road traffic, 10.99 Other insurance of motor vehicle liability. 11 AIRCRAFT LIABILITY INSURANCE is insurance that covers all types of liability for the use of aircraft including carrier's liability, covering: 11.01 Mandatory insurance of owners or users of aircraft against liability for damages to third parties, 11.02 Insurance of owners or users of aircraft against all types of liability (including carrier's liability for cargo received for transport in air traffic), 11.99 Other insurance of aircraft liability. 12 VESSEL LIABILITY INSURANCE is insurance that covers all types of liability arising from the use of sea, river, lake vessels and canal navigation vessels including carrier's liability, covering: 12.01 Insurance against liability of owners or users of sea ships (including carrier's liability for cargo received for transport), 12.02 Insurance against liability of owners or users of river, lake vessels and canal navigation vessels (including carrier's liability for cargo received for transport), 12.03 Mandatory insurance against liability of owners or users of self-propelled boats for damages to third parties, 12.99 Other insurance of vessel liability. 13 OTHER LIABILITY INSURANCE are insurances that cover all types of liability, except those listed under: 10, 11 and 12, covering: 13.01 Insurance of contractual liability of construction contractors, 13.02 Insurance of contractual liability of assembly contractors, 13.03 Insurance against liability of film producers, 13.04 Product liability insurance, 13.05 Insurance against liability in railway traffic, 13.06 Commercial guarantee insurance of manufacturers, sellers and suppliers, 13.07 General liability insurance, 13.08 Insurance against liability of project and other companies for damages to objects due to defective technical documentation, 13.09 Insurance against liability of project and other companies, 13.10 Insurance against liability of attorneys, 13.11 Insurance against liability of public notaries, 13.12 Insurance against liability of audit firms, 13.13 Insurance against liability of freight forwarders, 13.14 Insurance against liability of owners or users of marinas, 13.15 Insurance against liability of ship repairers, 13.16 Insurance against liability of security and detective activities, 13.17 Insurance against liability from property management activities, 13.18 Insurance against liability from medical, dental and pharmacy activities, 13.19 Insurance against liability of bankruptcy administrators, 13.20 Insurance against liability from insurance or reinsurance distribution activities, 13.21 Directors and Officers (D&O) liability insurance, 13.22 Tourist agency insurance against liability for package tours, 13.99 Other insurance of liability. 14 CREDIT INSURANCE is insurance that covers:
  • non-payment risk (or payment delay) due to general insolvency or other events (actions or facts),
  • export credits and other risks related to exports, trade and investments on foreign or domestic markets,
  • installment loans,
  • mortgage and Lombard credits,
  • agricultural credits, and
  • other credits and loans; covering: 14.01 Insurance of export receivables, 14.02 Insurance of other types of receivables, 14.03 Insurance of credit users against inability to repay credits due to mortality, accident, disability, job loss and similar risks, 14.99 Other insurance of credits. 15 GUARANTEE INSURANCE is insurance that covers direct and indirect guarantees for the fulfillment of debtor obligations, covering: 15.01 Insurance of guarantees involving direct and indirect guarantee risks, 15.02 Guarantee insurance, 15.99 Other insurance of guarantees. 16 VARIOUS FINANCIAL LOSS INSURANCE is insurance that covers:
  • professional risks,
  • inadequate income (generally),
  • bad weather,
  • lost profit,
  • unforeseen general expenses,
  • unforeseen business expenses,
  • loss of market value,
  • loss of rent or income,
  • other indirect business losses, except those listed above,
  • other non-business financial losses,
  • other forms of financial losses, covering: 16.01 Insurance of financial losses due to work stoppage caused by fire and some other hazards except earthquakes, 16.02 Insurance of financial losses due to work stoppage caused by machine breakage, 16.03 Insurance of various events due to atmospheric precipitation, 16.04 Insurance against losses from redemption of counterfeit foreign currency, 16.05 Insurance against risk of cancellation of tourist trips, 16.06 Insurance of financial losses due to work stoppage caused by earthquakes, 16.99 Other insurance of financial losses. 17 LEGAL EXPENSES INSURANCE is insurance that covers legal protection costs and court or other proceeding costs, covering: 17.01 Insurance of legal protection costs and court proceeding costs 17.99 Other insurance of legal expenses. 18 ASSISTANCE (ASSISTANCE) INSURANCE is insurance that covers assistance provided to persons who encounter difficulties during travel, away from home or usual residence, covering: 18.01 Tourist insurance, 18.03 Travel health insurance, 18.04 Assistance (assistance) insurance during travel, away from place of residence or domicile, 18.05 Automobile assistance insurance 18.99 Other assistance (assistance) insurances.
