Instruction No. 10 07 2025 RFE on Domiciliation of Direct and Portfolio Investment Operations

The Governor of the BCEAO issues Instruction No. 10 07 2025 RFE to standardize the domiciliation of direct and portfolio investment operations across the UEMOA. The directive mandates that approved intermediaries submit supporting documentation to the Ministry of Finance and the central bank within fifteen working days, ensuring that liquidation proceeds or loan repayments are accurately transferred under their responsibility. Furthermore, the Instruction repeals all prior conflicting provisions and takes effect on August 1, 2025.

5 The portion corresponding to the seventy-five percent borrowed from abroad may be effected by transfer from the UEMOA or, within the Union, in favor of a non-resident. Article 8: Transfer in respect of the liquidation of direct or portfolio investments, or repayment of loans Any liquidation of direct or foreign portfolio investments, which takes the form of a transfer between non-residents and residents, as well as any repayment of external loans, must be submitted to the approved intermediary responsible for settlement, along with supporting documents for such liquidation or loans. The approved intermediary is required to declare, for statistical purposes, to the Ministry in charge of Finance and the BCEAO, within fifteen working days after its completion, the liquidation of the investment or repayment of the loan. The approved intermediary transfers, under its responsibility, the proceeds from the liquidation of the investment or the amounts necessary for loan repayment, upon receipt of the required supporting documents. In the context of repaying a loan obtained abroad, repayment proofs must be submitted to the domiciliation file opened in respect of said loan. TITLE IV: FINAL PROVISIONS Article 9: Entry into force This Instruction repeals all prior provisions dealing with the same subject matter.
