Notice No. 23/2012 of April 30 on Statistical Information for the Balance of Payments

The National Bank of Angola, through Governor José de Lima Massano, issued Notice No. 23/2012 to regulate the mandatory submission of statistical data for the Balance of Payments and International Investment Position by Sonangol, its affiliates, and petroleum operators. Published in the Official Gazette No. 81/2012, of April 30 NOTICE NO. 23/2012 of April 30 SUBJECT: STATISTICAL INFORMATION – BALANCE OF PAYMENTS

Whereas it is necessary to regulate the obligation of compliance with the submission of statistical information, by the entities mentioned in Article 2 of Notice No. 11/12 of April 12, in order to ensure a reliable and timely information system for the compilation and processing of Balance of Payments statistics, as provided in Article 18 of Law No. 2/12 of January 13; Whereas it is further necessary to regulate the obligation of the aforementioned entities to submit an annual Forecast Exchange Budget to the National Bank of Angola, as provided in Article 19 of said Law; In the exercise of the competence conferred upon me under the combined provisions of Article 3 of Law No. 5/97 of June 27, and Articles 16(2)(a) and (c), 17, 40, and 51 of Law No. 16/10 of July 15; I HEREBY DETERMINE:

Article 1 (Subject Matter)

  1. This Notice aims to establish the type, format, and frequency of submission of information elements required for the recording and compilation of the balance of payments and international investment position, as well as the Forecast Exchange Budget to be provided by the entities referred to in the following article.

In accordance with the request and considering the current legislation on the matter, based on the documents submitted to this DJU, we hereby issue the following comments: FACTS Through Letter No. S/N from Attorney Dr. Filipe Paulino, the DCC was requested to grant the “dossier” of Company E.P.C.P. Lda, as a criminal case No. 80/05 against Mr. Manuel Gonzalez Barraganes is currently ongoing at the Namibe Provincial Court. Based on the content of the DCC Letter with Ref. No. DTC/CEX/028/2004, dated July 8, 2004, sent to E.P.C.P.- Production and C.

  1. For the purposes of the preceding paragraph, information must be provided in accordance with the instructions contained in Annex I and according to the format of Annex II of this Notice, which are integral parts thereof.

Article 2 (Scope)

  1. This Notice applies to the National Concessionaire – Sonangol, E.P. – and its national and foreign affiliates, as well as to the operator carrying out petroleum operations within the concession area.
  2. The provisions of this Notice also apply to Projects, for which the implementation approved by law determines the applicability of the legal regime for petroleum activity.

Article 3 (Confidentiality) Information provided under this Notice is strictly confidential and protected against any non-statistical use in accordance with Law No. 3/11 of January 14 and subsidiarily by other applicable regulations.

Article 4 (Frequency)

  1. Reporting of the information referred to in the preceding Article 1 must be submitted quarterly, with respective monthly breakdown, and must be sent in Excel format to the following address: https://portaldes.bna.ao/
  2. Information regarding the Forecast Exchange Budget is exempt from the frequency established in the preceding paragraph, with an annual submission schedule.
  3. In exceptional cases where the procedure for submitting the aforementioned statistical data is not feasible, reporting files may be sent through alternative electronic means.

Article 5 (Submission Deadline)

  1. The information mentioned in paragraph 1 of the preceding article must be sent to the National Bank of Angola by the 20th working day following the end of the respective quarter.
  2. The information mentioned in paragraph 2 of the preceding article must be sent to the National Bank of Angola by November 30 of the year prior to which it applies.
  3. For the purposes of this Notice, “working days” are considered all calendar days except Saturdays, Sundays, national holidays, and Carnival (Entrudo).

Article 6 (Appointment of Qualified Interlocutors)

  1. The entities referred to in Article 2 of this Notice must appoint interlocutors (at least one principal and one alternate) qualified to respond to potential questions regarding the reported information that the National Bank of Angola may pose, who shall be designated as “Statistical Correspondents”.
  2. For the purposes of the preceding paragraph, the aforementioned entities must use the model in Annex III to this Notice, which is an integral part.
  3. To ensure prompt responses to questions posed by the National Bank of Angola, the reporting entities mentioned in paragraph 1 above must ensure the permanent availability of at least one designated interlocutor, obligatorily replacing them definitively or temporarily when this condition cannot be met.
  4. Conversely, the National Bank of Angola will designate its interlocutors to clarify any questions arising from the application of this Notice.

Article 7 (Offenses) (Refusal and Falsity of Information) The refusal to provide the information stipulated in this Notice, as well as its falsity, are punished respectively with penalties applicable to the crimes of disobedience and false statements under criminal law, as provided in Article 17(2) of Law No. 16/10 of July 15.

Article 8 (Administrative Offenses) In case of non-compliance with the provisions of this Notice and complementary regulations, not covered in the preceding article, the legally established sanctioning regime will apply, namely those set forth in Articles 33 to 37 of Law No. 3/11 of January 14.

Article 9 (Entry into Force) This Notice enters into force on May 13, 2012. PUBLISHED Luanda, April 19, 2012
