Code of Social Security

The National Assembly of Bulgaria enacted the Code of Social Security to regulate public relations concerning state social insurance for illness, maternity, unemployment, old age, and death, as well as supplementary voluntary pension schemes.   1. state social insurance for general illness, occupational accident, occupational disease, maternity, unemployment, old age and death;
  2. supplementary social insurance, which includes: a) supplementary mandatory pension insurance for old age and death; b) (amended - State Gazette, No. 56 of 2006, effective from the date of entry into force of the Treaty of Accession of the Republic of Bulgaria to the European Union) supplementary voluntary pension insurance in funds for supplementary voluntary pension insurance for old age, disability and death or in funds for supplementary voluntary pension insurance under occupational schemes for old age; c) (new - State Gazette, No. 85 of 2023, effective from 10.10.2023) supplementary voluntary pension insurance under the Pan-European Personal Pension Product (PEPP) in accordance with Regulation (EU) 2019/1238 of the European Parliament and of the Council of 20 June 2019 on a Pan-European Personal Pension Product (PEPP) (OJ, L 198/1 of 25 July 2019), hereinafter referred to as "Regulation (EU) 2019/1238"; d) (previous letter c - State Gazette, No. 85 of 2023, effective from 10.10.2023) supplementary voluntary insurance for unemployment and/or professional qualification.

PART ONE STATE SOCIAL INSURANCE (Title amended - State Gazette, No. 67 of 2003)

Chapter One GENERAL PROVISIONS

Scope of Insurance Art. 2. (Amended - State Gazette, No. 109 of 2008, effective from 01.01.2009; amended and added, No. 61 of 2015, effective from 01.01.2016.) (1) (Previous text of Art. 2 - State Gazette, No. 109 of 2008, effective from 01.01.2009.) State social insurance provides benefits, assistance and pensions in cases of:

  1. temporary incapacity for work;
  2. temporarily reduced capacity for work;
  3. disability;
  4. maternity;
  5. (new - State Gazette, No. 1 of 2002, effective from 01.01.2002) unemployment;
  6. (previous item 5 - State Gazette, No. 1 of 2002, effective from 01.01.2002) old age;
  7. (previous item 6 - State Gazette, No. 1 of 2002, effective from 01.01.2002) death. (2) (New - State Gazette, No. 109 of 2008, effective from 01.01.2009.) The persons subject to state social insurance are insured in:
  8. the "General Illness and Maternity" Fund for general illness and maternity, which includes insurance for temporary incapacity for work, temporarily reduced capacity for work and maternity;
  9. the "Pensions" Fund for disability due to general illness, old age and death;
  10. (new - State Gazette, No. 61 of 2015, effective from 01.01.2016) the "Pensions for Persons under Art. 69" Fund for disability due to general illness, old age and death;
  11. (previous item 3 - State Gazette, No. 61 of 2015, effective from 01.01.2016) the "Occupational Accident and Occupational Disease" Fund for occupational accident and occupational disease, which includes disability, death, temporary incapacity for work and temporarily reduced capacity for work due to occupational accident and occupational disease;
  12. (previous item 4 - State Gazette, No. 61 of 2015, effective from 01.01.2016) the "Unemployment" Fund for unemployment. For the insured persons under Art. 4, para. 1, insurance contributions are paid in the amounts determined for the "General Illness and Maternity", "Pensions", "Pensions for Persons under Art. 69", "Occupational Accident and Occupational Disease", "Unemployment" and "Teachers' Pension Fund". For the insured persons for occupational accident and occupational disease, insurance contributions are paid in the amounts determined for the "Occupational Accident and Occupational Disease" Fund. (5) (New - State Gazette, No. 109 of 2008, effective from 01.01.2009.) For the insured persons for disability due to general illness, for old age and for death, the insurance contributions are paid in the amounts determined for the "Pensions" Fund. (6) (New - State Gazette, No. 61 of 2015, effective from 01.01.2016.) Teachers are insured for old age in the Teachers' Pension Fund with a separate insurance contribution.

Principles of Insurance Art. 3. State social insurance is implemented on the basis of the principles of:

  1. mandatory and universal nature of insurance;
  2. solidarity of the insured persons;
  3. equal treatment of the insured persons;
  4. social dialogue in the management of the insurance system;
  5. fund-based organization of insurance funds.

Performance of Obligations during a State of Emergency Art. 3a. (New - State Gazette, No. 28 of 2020, effective from 13.03.2020.) (1) In the event of a state of emergency under Art. 84, item 12 of the Constitution of the Republic of Bulgaria:

  1. the time limits established by law for insured persons and pensioners in connection with the application of Part One, Chapters Four to Eight shall cease to run;
  2. applications, complaints and other documents regarding monetary benefits, assistance and pensions shall be submitted electronically in accordance with the Electronic Document and Electronic Authentication Services Act or with a personal identification code, or through a licensed postal operator;
  3. the failure of officials under Art. 40, para. 3, Art. 54j, para. 1 and Art. 98, para. 1 to rule within the prescribed time limit due to reasons attributable to the state of emergency shall not be considered as a tacit refusal within the meaning of Art. 58, para. 1 of the Administrative Procedure Code. (2) The documents under para. 1, item 2, submitted by insured persons and pensioners within 14 days after the cancellation of the state of emergency at the respective territorial division of the National Social Insurance Institute, shall be considered as submitted within the time limit.

The following are compulsorily insured for general illness and maternity, disability due to general illness, old age and death, occupational accident and occupational disease and unemployment under this Code:

  1.
