Notice No. 3/GBM/2016, of 14 November - Adoption of the Extraordinary Sanitation Measure for Moza Banco and Appointment of an Interim Board of Directors

MINISTRY OF STATE ADMINISTRATION AND PUBLIC SERVICE AND MINISTRY OF ECONOMY AND FINANCE

Ministerial Decree No. 80/2016 of 14 November

Given the need to approve the Organic Statute of the Provincial Directorate for Maritime, Inland Waters and Fisheries Affairs, and in exercise of the powers conferred by Article 6 of Decree No. 24/2015, of 30 October, the Minister of State Administration and Public Service and the Minister of Economy and Finance determine:

ARTICLE 1 (Approval)

The Organic Statute of the Provincial Directorate for Maritime, Inland Waters and Fisheries Affairs attached hereto is approved, forming an integral part of this Ministerial Decree.

ARTICLE 2 (Internal Regulations)

The Provincial Government is responsible for approving the Internal Regulations of the Provincial Directorate for Maritime, Inland Waters and Fisheries Affairs within sixty days from the date of publication of this Organic Statute.

ARTICLE 3 (Staffing Establishment)

The Minister overseeing State Administration and Public Service is responsible for approving the staffing establishment of the Provincial Directorate for Maritime, Inland Waters and Fisheries Affairs, upon proposal by the Provincial Government, within ninety days from the date of publication of this Statute.

ARTICLE 4 (Revocation)

Resolution No. 3/2002, of 13 March from the National Public Service Council is revoked, along with all legislation contrary to this Ministerial Decree.

ARTICLE 5 (Entry into Force)

This Ministerial Decree enters into force on the date of its publication.

Organic Statute of the Provincial Directorate for Maritime, Inland Waters and Fisheries Affairs

CHAPTER I General Provisions

ARTICLE 1 (Nature)

The Provincial Directorate for Maritime, Inland Waters and Fisheries Affairs is the provincial body of the State apparatus that, in accordance with the principles, objectives and tasks defined by the Government, directs and ensures the execution of activities within the scope of Maritime, Inland Waters and Fisheries Affairs at the provincial level.

c) Provide logistical, technical and administrative assistance to the Provincial Director and the Deputy Provincial Director; d) Record incoming and outgoing correspondence, organize communication of dispatches to interested parties and archive the official documents of the Provincial Director and Deputy Provincial Director; e) Transmit and control the execution of decisions and instructions from the Provincial Director and Deputy Provincial Director; f) Ensure screening and expedite official business directed to the Director's Office; g) Organize sessions of the Directorate collectives and other meetings directed by the Provincial Director and Deputy Provincial Director; and h) Exercise any other functions assigned to them under the Organic Statute of the Directorate and applicable legislation.

  1. The Provincial Director's Office is headed by a Chief of Staff.

CHAPTER III Collective Bodies

ARTICLE 16 (Types of Collective Bodies)

The Provincial Directorate for Maritime, Inland Waters and Fisheries Affairs has the following collective bodies: a) Directorate Collective; and b) Coordinating Council.

ARTICLE 16 (Directorate Collective)

  1. The Directorate Collective is the body responsible for analyzing and issuing opinions on matters pertaining to the Provincial Directorate for Maritime, Inland Waters and Fisheries Affairs, and is convened and directed by the Provincial Director.
  2. The Directorate Collective meets ordinarily every fifteen days and extraordinarily whenever service needs require it.
  3. The Directorate Collective comprises: a) Provincial Director; b) Deputy Provincial Director; c) Inspector; d) Deputy Inspector; e) Heads of Departments; f) Heads of Divisions; and g) Chief of Staff.
  4. Technicians, specialists and sector partners may be invited to participate in the Directorate Collective depending on the subject matter.

ARTICLE 17 (Coordinating Council)

  1. The Coordinating Council is an Advisory Body, directed by the Provincial Director for Maritime, Inland Waters and Fisheries Affairs, through which it coordinates, plans and controls the action of all organizational units and institutions related to the Provincial Directorate for Maritime, Inland Waters and Fisheries Affairs.

  2. The functions of the Coordinating Council, among others set forth in this Organic Statute or other legislation, are as follows: a) Coordinate and evaluate activities aimed at fulfilling the duties and powers of the Provincial Directorate for Maritime, Inland Waters and Fisheries Affairs; b) Issue opinions on plans, policies and strategies relating to the duties and powers of the Provincial Directorate for Maritime, Inland Waters and Fisheries Affairs and make necessary recommendations; c) Assess the programs, annual plan and budget of activities of the Provincial Directorate for Maritime, Inland Waters and Fisheries Affairs; and d) Promote the uniform application of strategies, methods and techniques aimed at implementing policies in the Maritime, Inland Waters and Fisheries sector.

  3. The Coordinating Council is composed of: a) Provincial Director; b) Deputy Provincial Director; c) Inspector; d) Deputy Inspector; e) Heads of Departments; f) Heads of Divisions; g) Chief of Staff; h) Heads of Sections; i) Directors of District Services related to the Provincial Directorate for Maritime, Inland Waters and Fisheries Affairs; and j) Provincial executives from other activity areas related to the Provincial Directorate for Maritime, Inland Waters and Fisheries Affairs.

  4. Technicians and specialists with local-level responsibilities, as well as sector partners, may be invited to participate in the Coordinating Council depending on the subject matter.

  5. The Coordinating Council meets ordinarily once a year and extraordinarily when authorized by the Provincial Governor.

CHAPTER IV Final and Transitional Provisions

ARTICLE 18 (Doubts and Omissions)

  1. Doubts and omissions arising in the application of this Statute are resolved by a decree from the Ministers overseeing State Administration and Public Service and Economy and Finance.
  2. The establishment of the Provincial Director's Chief of Staff position is conditional upon approval of a specific professional qualification.

BANK OF MOZAMBIQUE

Notice No. 3/GBM/2016 of 14 November

The financial and prudential situation of Moza Banco, SA has been deteriorating seriously, which led the Bank of Mozambique to adopt extraordinary sanitation measures provided for in Article 83 of Law No. 15/99, of 1 November, as amended by Law No. 9/2004, of 21 July - the Credit Institutions and Financial Companies Law.

Given the need to reinforce these measures in order to protect the interests of depositors, investors and other creditors, as well as safeguard the normal operating conditions of the monetary, financial and foreign exchange markets, the Bank of Mozambique, pursuant to Articles 81 and 84 of the aforementioned law, determines:

  1. Suspend the members of the Board of Directors and the Executive Committee of Moza Banco.

  2. Appoint an interim Board of Directors with the following composition: a) João Filipe Figueiredo Júnior - Chairman; b) Samuel Banze - Director; and c) Sérgio Eduardo Ribeiro - Director.

  3. The interim Board of Directors referred to in the preceding paragraph is appointed for a period of six months, renewable, and holds the powers and duties set forth in the law and the statutes of Moza Banco SA.

This Notice enters into force immediately.

Any doubts arising from the interpretation and application of this Notice shall be submitted to the Regulation and Licensing Department.
