MINISTRY OF SCIENCE AND TECHNOLOGY, HIGHER EDUCATION AND TECHNICAL AND VOCATIONAL TRAINING DISPATCH Under the provisions of paragraph 3 of Article 8 of Ministerial Decree No. 119/2014, of August 13, and in the exercise of the powers conferred by paragraph c) of Article 3 of Presidential Decree No. 14/2015, of March 16, I determine:
BANCO DE MOÇAMBIQUE Dispatch Considering that: a) Nosso Banco, SA has been presenting a growing deterioration of its main prudential and profitability indicators, namely weak capitalization, an unsustainable economic-financial structure, as well as serious liquidity and management problems; b) Nosso Banco, SA presented a restructuring plan in 2014, including recapitalization and alteration of its management structure, which did not yield the expected results; c) Nosso Banco, SA, after successive defaults on submitted recovery plans, demonstrated inability to exit the difficult economic-financial situation it is in, thereby placing itself in a practically unviable situation; d) Nosso Banco, SA, by not executing the submitted recovery plans, not only violated Central Bank determinations but also failed to restore equilibrium in its economic-financial situation; Having in mind that: e) Violation of the laws and regulations governing credit institutions and financial companies, as well as non-compliance with Banco de Moçambique determinations, which jeopardize the interests of depositors and other creditors or the normal functioning conditions of money, financial, and foreign exchange markets, constitute grounds for revocation of the operating authorization, under paragraph e) of paragraph 1 of Article 17 of Law No. 15/99, of November 1, as amended by Law No. 9/2004, of July 21 – Credit Institutions and Financial Companies Law (LICSF);
In the exercise of powers conferred by paragraph 1 of Article 18 of LICSF, combined with Article 5 of Law No. 30/2007, of December 18, which regulates the administrative liquidation process of credit institutions and financial companies, I decide: a) To revoke the authorization to conduct business granted to Nosso Banco, SA; b) To order the dissolution and liquidation of Nosso Banco, SA; c) To appoint Deloitte & Touche (Moçambique) Lda. as president of the liquidation committee of Nosso Banco, SA. Notice No. 4 / GBM/2016 of December 14 Decree No. 11/2016, of May 16, Regulation of the Private Management Credit Information System Law, establishes the obligation for credit information centers to pay processing fees for authorization and license applications. In these terms, under the powers conferred by paragraph 3 of Article 16 of the aforementioned Regulation, I determine: ARTICLE 1 (Object) This Notice sets the license application processing fee and the annual license fee of credit information centers.
