Executive Decree No. 24-129 of 30 Ramadan 1445 Corresponding to April 9, 2024 Modifying and supplementing Executive Decree No. 98-170 of 23 Muharram 1419 Corresponding to May 20, 1998 Relating to the fees collected by the Organization and Surveillance Commission for Stock Market Operations.
———— The Prime Minister, On the report of the Minister of Finance, Having regard to the Constitution, particularly its Articles 112-5° and 141 (paragraph 2); Having regard to Law No. 20-07 of 12 Shawwal 1441 corresponding to June 4, 2020, establishing the supplementary finance law for 2020, particularly its Article 45; Having regard to Law No. 21-16 of 25 Jumada al-Awwal 1443 corresponding to December 30, 2021, establishing the finance law for 2022, particularly its Article 163; Having regard to Presidential Decree No. 23-404 of 27 Rabi' al-Thani 1445 corresponding to November 11, 2023, appointing the Prime Minister; Having regard to Presidential Decree No. 23-119 of 23 Sha'ban 1444 corresponding to March 16, 2023, as amended, appointing the members of the Government; Having regard to Executive Decree No. 98-170 of 23 Muharram 1419 corresponding to May 20, 1998, relating to the fees collected by the Organization and Surveillance Commission for Stock Market Operations;
Decrees:
Article 1. — The provisions of Article 2 of Executive Decree No. 98-170 of 23 Muharram 1419 corresponding to May 20, 1998, relating to the fees collected by the Organization and Surveillance Commission for Stock Market Operations, are modified, supplemented, and drafted as follows:
"Art. 2. — The fees collected on acts and services rendered by the Commission are fixed as follows: — a fee upon the request for visas for the issuance of securities or the offering of securities to the public, the admission of securities to the stock exchange, as well as for the public offer of sale, purchase, exchange, or withdrawal of securities admitted to stock exchange trading; — a fee upon the request for approval of a stock market intermediary, a participatory investment advisor, a collective investment scheme, and a portfolio management company; — a fee upon the registration of an agent authorized to conduct stock exchange negotiations, a stock market promoter, and an appraiser expert tasked with evaluating companies candidates for stock market listing; — a fee upon the request for authorization of a custodian-depository; — a fee upon the request for recognition of a financial rating; — a fee upon the investigation conducted by the Commission at the level of stock market intermediaries; — a fee upon the processing of technical disputes resulting from the interpretation of legislative and regulatory texts governing the functioning of the stock exchange; — a fee collected from the stock exchange management company.".
Art. 2. — This decree shall be published in the Official Journal of the People's Democratic Republic of Algeria.
