Instruction No. 2018-I-04 of June 7, 2018 amending Instruction No. 2016-I-07 regarding information to be transmitted to the ACPR on statutory auditors

The Prudential Control and Resolution Authority (ACPR) issued Instruction No. 2018-I-04 to amend the reporting procedures for statutory auditors under Instruction No. 2016-I-07. The amendment mandates that from January 1, 2020, all covered establishments must submit information exclusively via the Banque de France's OneGate portal. Prior to this date, a transitional period allows for distinct submission methods based on the type of entity, including specific forms and email submissions.

PRUDENTIAL CONTROL AND RESOLUTION AUTHORITY

Instruction No. 2018-I-04 amending Instruction No. 2016-I-07 regarding information to be transmitted to the Prudential Control and Resolution Authority on statutory auditors

The Prudential Control and Resolution Authority, Having regard to the Monetary and Financial Code, in particular Articles L. 612-1, L. 612-24, and L. 612-44; Having regard to the opinion of the Prudential Affairs Consultative Committee dated April 23, 2018. DECIDES:

Article 1 : Article 3 of Instruction No. 2016-I-07 is replaced by the following provisions:

"The information provided for in Article 2 of this Instruction must be communicated to the ACPR according to the following procedures:

1° From the date of publication of this Instruction until December 31, 2019: 1.1. For the persons subject to the provisions mentioned in A of I of Article L. 612-2 of the Monetary and Financial Code, with the exception of the entities referred to in 4° bis, 5°, 6°, 7°, 11° and 12°: by completing a dedicated entry form via the "OneGate" portal of the Banque de France, accessible at the following address https://onegate.banque-france.fr; 1.2. For the persons subject to the provisions mentioned in B of I of Article L. 612-2 of the Monetary and Financial Code, with the exception of mixed insurance group companies: by completing the declarative sheet provided for in the annex and transmitted electronically to the email address info-cac@acpr.banque-france.fr, both in the proposed Excel format and in a signed PDF version. The declarative sheet must be signed by one of the persons mentioned, as applicable, in Articles L. 322-3-2 and L. 329-1 of the Insurance Code, in Article L. 211-13 of the Mutual Code, and in Article L. 931-7-1 of the Social Security Code.

2° From January 1, 2020, and for all covered establishments mentioned in Article 1, without distinction: by completing a dedicated entry form via the "OneGate" portal of the Banque de France, accessible at the following address https://onegate.banque-france.fr. "
