Instruction No. 2013-I-06 of May 28, 2013 amending Instruction No. 2011-I-14 of September 29, 2011 on the monitoring of risks on housing loans in France

The Prudential Control Authority issued Instruction No. 2013-I-06 to amend the regulatory framework for monitoring risks associated with housing loans in France. The amendment excludes loans granted to real estate holding companies (SCI) from the scope, updates the data submission code from CREDIT_HABITAT to CREDITHAB, and mandates monthly XBRL reporting. These changes entered into force on March 1, 2014, requiring institutions to submit data for January and February 2014 with their first transmission.

PRUDENTIAL CONTROL AUTHORITY

Instruction No. 2013-I-06 amending Instruction No. 2011-I-14 of September 29, 2011 on the monitoring of risks on housing loans in France

The Prudential Control Authority, Having regard to the Monetary and Financial Code, in particular Articles L. 515-13 to L. 515-39 as well as L. 612-24 and R. 515-2 to R. 515-17; Having regard to Instruction No. 2011-I-14 of September 29, 2011 on the monitoring of risks on housing loans in France; Having regard to the opinion of the Consultative Commission on Prudential Affairs dated May 13, 2013; Decides:

Article 1

  • At the end of paragraph b) of Article 1, the following sentence is added: "Loans granted to real estate holding companies (SCI), regardless of their purpose, are likewise excluded."

Article 2 - In Article 2, the term "CREDIT_HABITAT" is replaced by "CREDITHAB".

Article 3 - Article 3 of Instruction No. 2011-I-14 of September 29, 2011 is replaced by: "The CREDITHAB table is sent to the General Secretariat of the Prudential Control Authority in XBRL format on a monthly basis, no later than the last day of the month following the date of the monthly closing, according to the technical specifications necessary for their processing as defined by the General Secretariat of the Prudential Control Authority."

Article 4 - The annex to Instruction No. 2011-I-14 of September 29, 2011 is replaced by the present annex.

Article 5 - This instruction enters into force as of March 1, 2014. Establishments subject to this instruction shall transmit, with the first submission, the data relating to the deadlines of January 31 and February 28, 2014.
