DECREE of 7 December 2020 on the submission of information by financial service intermediaries to the Czech National Bank
The Czech National Bank, pursuant to Section 41(3) of Act No. 6/1993 Coll., on the Czech National Bank, as amended by Act No. 227/2013 Coll., has determined:
Section 1 Subject Matter This decree establishes the content, format, deadlines, and method for compiling and submitting information on the activities of financial service intermediaries to the Czech National Bank.
Section 2 Definition of Terms For the purposes of this decree, the following terms are understood: a) "report" means a structured set of data created by a financial service intermediary, designated as Report ZFS (CNB) 01-01 "Annual Report on the Activities of a Financial Service Intermediary"; b) "financial service intermediary" means an independent insurance and reinsurance intermediary, an investment intermediary, an independent consumer credit intermediary, and an independent supplementary pension savings intermediary.
Section 3 Report of the Financial Service Intermediary (1) A financial service intermediary shall compile a report for each calendar year and submit it to the Czech National Bank by 31 March of the following year. (2) The content of the report is set out in the Annex to this decree. (3) A financial service intermediary that is simultaneously a bank, a savings and loan association, an insurance company, a reinsurance company, a non-bank consumer credit provider, a payment institution, a payment service provider based on a postal license, an electronic money institution, an account information service provider, a pension company, or a securities dealer shall compile the report only to the extent of the data specified in Parts 2 to 5 of the Annex to this decree. (4) A financial service intermediary that is a self-employed natural person shall not submit data regarding its financial position and results of its operations in the report, as specified in Part 1 of the Annex to this decree. (5) A financial service intermediary shall convert data expressed in foreign currency into data expressed in Czech koruna using the foreign exchange market rate published by the Czech National Bank for 31 December of the calendar year to which the report relates, unless a legal regulation governing accounting provides otherwise. For data in currencies for which the Czech National Bank does not publish foreign exchange market rates, the financial service intermediary shall perform the conversion in accordance with the legal regulation governing accounting.
Section 4 Submission of Reports (1) A financial service intermediary shall submit the report to the Czech National Bank in electronic form as a data message in the format and structure of data files. (2) The data message referred to in paragraph 1 shall be transmitted via means enabling remote access through the internet application or user interface of the Czech National Bank's collection system. (3) A financial service intermediary shall notify the Czech National Bank of the name, office address, telephone number, and email address of the contact person. The financial service intermediary shall inform the Czech National Bank without undue delay of any changes to these details.
Section 5 Corrections and Changes in Reports (1) If an error is discovered or if a change or addition is made to the data contained in the report after its submission to the Czech National Bank, the financial service intermediary shall promptly submit the report again to the Czech National Bank with the corrected data. (2) Corrected reports shall be submitted in the manner specified in Section 4, together with information regarding the content and reason for the correction.
Section 6 Entry into Force This decree shall enter into force on 1 January 2021.
