Central Bank of Libya Circular No. 15/2012

The Central Bank of Libya issued Circular No. 15/2012 to mandate commercial banks and the Libyan Foreign Bank to open transparent, temporary electoral accounts for individual candidates and political entities participating in the General National Congress elections. The directive establishes two account categories subject to standard Know Your Customer (KYC) requirements, enables the National Elections Commission to monitor account balances and transactions, and specifies that accounts must be closed upon publication of the final candidate list or after final election results. Banks are instructed to process these account openings without requiring prior verification of candidacy status, as the required supporting documents will be submitted alongside standard candidacy applications.

Greetings,

Based on the provisions of Law No. (1) of 2005 regarding Banks, and in implementation of the supervisory and regulatory role exercised by the Central Bank of Libya over commercial banks. And based on the provisions of Circular No. (2009/13) issued on 1/12/2009, which generalized the decision of the Board of Directors of the Central Bank of Libya No. (36) issued on 15/11/2009, regarding the rules governing the opening of bank accounts in commercial banks. And with reference to the letter from the Chairman of the National Elections Commission bearing Reference No. 92 dated 3/5/2012, addressed to the Governor of the Central Bank of Libya, which referred to Law No. (3) of 2012 regarding the establishment of the Supreme Commission for Elections, and Law No. (4) of 2012 regarding the election of the General National Congress, and Commission Resolution No. (38) of 2012 regarding the candidate registration regulations, which stipulates in Article (5) the necessity of opening an account in one of the local banks. And within the framework of preparing for the electoral process and ensuring its timely conduct, the Chairman of the Commission requested directing all operating banks to open temporary accounts for electoral campaigns that are transparent (open) to all, with the condition that these accounts be closed upon completion of the election of General National Congress members.

Therefore, we inform you that after presenting the matter to the Legal Department of the Central Bank of Libya to establish an executive framework for the Supreme Commission's request, and based on the opinion of the Legal Affairs Department regarding opening bank accounts for candidates (individuals and lists) as follows:

  • 1- Opening special current accounts called electoral account of two categories:
    • Electoral account for an individual candidate: subject to standard KYC (Know Your Customer) rules. (kyc)
    • Electoral account for a political entity: opened in the name of the list head or his delegate – mentioning the name of the nominated entity/list, along with compliance with KYC rules.
  • Enabling the Supreme Commission for Elections to view the balance and transactions of accounts opened by banks for General National Congress elections.
  • The opening of the electoral account does not require verification of the candidacy fact, as the documents for opening the electoral account are among the documents submitted with candidacy.
  • All electoral accounts for individual and political entity candidates whose candidacy was not approved shall be closed upon publication of the final candidate list (Article 15 of the candidate registration regulations).
  • Electoral accounts for individual and political entity candidates shall be closed after the announcement of final election results.

Therefore, we request your compliance with requests to open bank accounts for the General National Congress elections submitted to you according to the aforementioned controls.
