THE INTERMINISTERIAL COMMITTEE FOR CREDIT AND SAVINGS

HAVING REGARD TO Legislative Decree 1 September 1993, No. 385, containing the Consolidated Act of laws on banking and credit matters;

HAVING REGARD IN PARTICULAR to Article 2, paragraph 4, second sentence, of the aforementioned Legislative Decree 385/93, pursuant to which "the CICR determines the rules concerning its own organization and functioning";

UPON THE PROPOSAL of the President;

D E L I B E R A

The following internal regulations of this Committee are approved, pursuant to Article 2, paragraph 4, second sentence, of Legislative Decree 385/93.

CHAPTER I REGULATION OF THE MEETINGS OF THE INTERMINISTERIAL COMMITTEE FOR CREDIT AND SAVINGS

Art. 1. Participation in Committee Meetings

  1. The following participate in CICR meetings: the Minister of the Treasury, Budget and Economic Planning, acting as President; the Minister for Foreign Trade; the Minister for Agricultural Policies; the Minister of Finance; the Minister of Industry, Commerce and Craftsmanship; the Minister of Public Works; and the Minister for Community Policies, as well as the Governor of the Bank of Italy.

  2. The President may invite other Ministers to attend individual meetings, without voting rights, regarding specific items placed on the agenda.

SECRETARIAT

  1. Participation in CICR meetings is mandatory, unless there is a justified impediment.

  2. The General Director of the Treasury performs the functions of Secretary; in the event of their absence or impediment, these functions are performed by the Head of the CICR Secretariat Office, provided for in the subsequent Art. 3.

  3. CICR meetings are held at the Ministry of the Treasury, Budget and Economic Planning, unless the President decides otherwise.

Art. 2. Convening the Committee

  1. The President convenes the Committee and sets the agenda.

  2. The Ministers are sent the notice of convening of the Committee and a copy of the documentation relating to the issues included in the agenda, normally three days before the meeting.

  3. The President may add to the already issued agenda for the discussion of non-deferrable issues, giving immediate notice to the affected Ministers.

Art. 3. CICR Secretariat Office

  1. The CICR Secretariat Office, established by the deliberation of 13 October 1950, is composed of personnel from the Bank of Italy, normally from the Credit and Financial Supervision Services.

  2. The functions indicated in the establishing deliberation remain assigned to the Secretariat Office, which operates under the direct authority of the General Director of the Treasury - Secretary of the CICR.

Art. 4. Committee Meetings

  1. Meetings are opened and closed by the President, who places items on the agenda and directs the proceedings.

  2. The Committee is validly constituted with the presence of the majority of its members and deliberates with the favorable vote of the majority of those present.

  1. Before any vote, those who dissent may request that this be recorded in the minutes, possibly with a brief justification. In any case, public communication or expression of the dissenting opinion is not permitted.

Art. 5. Methods of Information on Committee Work

  1. At the end of the meetings, the CICR Secretary normally drafts the statement regarding the Committee's work, submitting it for approval to the President.

CHAPTER II REGULATION OF THE ACTS OF THE INTERMINISTERIAL COMMITTEE FOR CREDIT AND SAVINGS

Art. 6. Official Acts of the Committee

  1. The official acts of the Committee are:

a) the minutes;

b) the collection of deliberations.

Art. 7. Content of the Minutes

  1. The minutes report, among other things, for each meeting:

a) the agenda, with specific indication of the topics;

b) the record of the discussion divided by topic, with the result of the votes without indicating the names of those who cast the votes;

c) the full text, also by reference to attachments, of the approved acts.

Art. 8. Preparation, Approval and Preservation of the Minutes

  1. The minutes are drafted by the person who performed the functions of secretary of the meeting, who signs them and submits them for the signature of the President.

  1. The minutes are deemed approved upon the signature of the President, who, if deemed necessary, may submit the entire text or individual points thereof for approval by the Committee.

  2. Approved minutes are kept by the CICR Secretariat.

Art. 9. Preparation and Preservation of the Collection of Deliberations

  1. The collection of deliberations reports, in chronological order, the regulatory acts and other deliberations adopted by the Committee, in their full text.

  2. In no case does the deliberation inserted in the collection contain indications regarding the opinions expressed by individual participants and the number of favorable and unfavorable votes.

  3. No deliberation may be inserted in the collection unless the minutes of the meeting in which it was adopted have been approved.

Art. 10. Publicity of Official Acts

  1. Deliberations of a general nature issued pursuant to Legislative Decree 1 September 1993, No. 385, are published in the Official Gazette of the Italian Republic.

  2. The Committee's minutes are a confidential document. The Minister members of the Committee may view them at any time.

  3. The President may authorize other subjects to view the minutes, also in relation to individual items on the agenda, unless the Committee has deliberated to the contrary.
