Regulation of the Commodity Futures Trading Regulatory Agency Number 2 of 2021 Concerning Technical Requirements for Controlled Atmosphere Storage (CAS) Warehouses in the Warehouse Receipt System

The Commodity Futures Trading Regulatory Agency of Indonesia issued Regulation Number 2 of 2021 to establish technical requirements for Controlled Atmosphere Storage (CAS) warehouses within the Warehouse Receipt System. The regulation defines CAS as a closed-room storage method for agricultural commodities where oxygen, carbon dioxide, nitrogen, ethylene, temperature, and humidity are controlled. It mandates specific structural, atmospheric control, facility, and equipment standards, classifying warehouses into three tiers (A, B, and C) based on the strictness of these technical and location-based criteria.

CONCERNING

TECHNICAL REQUIREMENTS FOR CONTROLLED ATMOSPHERE STORAGE (CAS) WAREHOUSES

IN THE WAREHOUSE RECEIPT SYSTEM

BY THE GRACE OF GOD THE ALMIGHTY,

THE HEAD OF THE COMMODITY FUTURES TRADING REGULATORY AGENCY OF THE REPUBLIC OF INDONESIA,

Considering: a. that in order to implement the provisions of Article 1 paragraph (6) of the Commodity Futures Trading Regulatory Agency Regulation Number 1 of 2021 concerning Technical Requirements for Warehouses in the Warehouse Receipt System, and to meet the needs of warehouses in the Warehouse Receipt System that are suitable for the characteristics of goods that are perishable and not durable, it is necessary to regulate technical requirements regarding Controlled Atmosphere Storage (CAS) Warehouses in the Warehouse Receipt System;

b. that based on the considerations as referred to in letter a, it is necessary to establish a Commodity Futures Trading Regulatory Agency Regulation concerning Technical Requirements for Controlled Atmosphere Storage (CAS) Warehouses in the Warehouse Receipt System;

Recalling:

DECIDES:

To establish: A COMMODITY FUTURES TRADING REGULATORY AGENCY REGULATION CONCERNING TECHNICAL REQUIREMENTS FOR CONTROLLED ATMOSPHERE STORAGE (CAS) WAREHOUSES IN THE WAREHOUSE RECEIPT SYSTEM.

Article 1

Warehouses in the Warehouse Receipt System that will be used for goods requiring Controlled Atmosphere Storage (CAS) storage mechanisms must meet the technical requirements established by the Commodity Futures Trading Regulatory Agency.

Article 2

The technical requirements for Controlled Atmosphere Storage (CAS) Warehouses in the Warehouse Receipt System as referred to in Article 1 are contained in the Appendix which is an integral part of this Agency Regulation.

IN THE WAREHOUSE RECEIPT SYSTEM

1. Scope

This Technical Regulation establishes the technical requirements that must be possessed by closed warehouses with Controlled Atmosphere Storage (CAS) technology for the storage of agricultural commodities in the Warehouse Receipt System.

CAS is a method of storing agricultural product outputs in a closed space where the content of oxygen, carbon dioxide, nitrogen, ethylene, as well as the temperature and humidity of the storage space can be adjusted or controlled.

The agricultural commodities referred to include crop cultivation results, plantations, and horticulture that fall under the Minister's regulation concerning Trade as goods that can be stored in warehouses in the implementation of the Warehouse Receipt System.

This standard includes terms and definitions, requirements, and classification of CAS Warehouses.

2. Terms and Definitions

2.1 Warehouse A warehouse is all immovable and non-movable rooms not visited by the general public, but used specifically as a place for storing goods that can be traded generally and meet other requirements established by the Minister.

2.2 Controlled Atmosphere Storage (CAS) A single building unit consisting of civil construction and installation works for the storage room, consisting of insulation panels and designed with a special design so that it can control temperature, humidity, and air composition content.

2.3 Warehouse Classification Grouping of warehouse classes based on fulfillment of warehouse technical requirements consisting of location aspects, transportation access, construction, facilities, and warehouse equipment as Class A, B, or C Warehouses.

2.4 Location Requirements Requirements related to warehouse location and transportation access.

2.5 Building Technical Requirements Requirements related to warehouse construction and building materials, CAS systems, supporting facilities, and warehouse equipment.

2.6 Insulation Panel Warehouse building material that is an insulator (resisting cold and air content) in sheet form, made of polyurethane or other insulation materials protected by steel plates or other materials coated with anti-rust material.

2.7 Skin Panel Protector of insulation panels.

2.8 Insulation Wall Panel Insulation panels in CAS warehouses that function as room walls.

2.9 Insulation Ceiling Panel Insulation panels in CAS warehouses that function as room ceilings.

2.10 Insulation Floor Panel / Insulated Slab Insulation panels in CAS warehouses that function as floor material, in sheet form made of polyurethane or other insulation materials, without coating, to be embedded under the CAS warehouse floor.

2.11 Refrigerator Part of the CAS system that functions to control air temperature.

2.12 Compressor Part of the cooling (refrigeration) unit in CAS that functions to circulate refrigerant in the cooling system.

2.13 Condenser Part of the cooling (refrigeration) unit in CAS that functions to dissipate heat in the cooling system.

2.14 Evaporator Part of the cooling (refrigeration) unit in CAS that functions to absorb heat in the CAS room.

2.15 Vacuum Pressure Stabilizing Air Balloon (Balancing Bag) A device that functions to stabilize air pressure inside the CAS room.

2.16 Circulation Air Blower A device that functions to regulate air circulation in the CAS room.

2.17 Fire Extinguishing Equipment Equipment used for extinguishing fires in case of fire, which can be in the form of Portable Fire Extinguishers (APAR) and/or active hydrant installations.

2.18 Loading and Unloading Facilities Facilities to facilitate the unloading of agricultural commodities from transport vehicles into the warehouse, or loading agricultural commodities from the warehouse onto transport vehicles.

2.19 Hazardous Chemicals Chemicals containing hazardous and/or toxic materials that, due to their properties (corrosive, oxidizer, reactive, radioactive, explosive, or flammable) and/or concentration and/or quantity, either directly or indirectly, can pollute the environment and/or endanger human health, survival of humans and/or other living creatures.

2.20 Former Chemical Plant Location A location that was previously used as a hazardous chemical plant.

2.21 Former Garbage Dump Location A location that was previously used as a Final Disposal Site (TPA).

2.22 Class I Road Arterial and collector roads that can be passed by Motor Vehicles with a width not exceeding 2,500 (two thousand five hundred) millimeters, length not exceeding 18,000 (eighteen thousand) millimeters, maximum height 4,200 (four thousand two hundred) millimeters, and heaviest axle load 10 (ten) tons.

2.23 Class II Road Arterial, collector, local, and environmental roads that can be passed by Motor Vehicles with a width not exceeding 2,500 (two thousand five hundred) millimeters, length not exceeding 12,000 (twelve thousand) millimeters, maximum height 4,200 (four thousand two hundred) millimeters, and heaviest axle load 8 (eight) tons.

2.24 Class III Road Arterial, collector, local, and environmental roads that can be passed by Motor Vehicles with a width not exceeding 2,100 (two thousand one hundred) millimeters, length not exceeding 9,000 (nine thousand) millimeters, maximum height 3,500 (three thousand five hundred) millimeters, and heaviest axle load 8 (eight) tons.

2.25 Special Class Road Arterial roads that can be passed by Motor Vehicles with a width exceeding 2,500 (two thousand five hundred) millimeters, length exceeding 18,000 (eighteen thousand) millimeters, maximum height 4,200 (four thousand two hundred) millimeters, and heaviest axle load more than 10 (ten) tons.

2.26 Official Seal Mark A valid seal mark given periodically by the competent authority based on accuracy regarding measuring, weighing, and counting instruments and their accessories.

2.27 Drainage/Water Channel A system for regulating water flow to disposal.

2.28 Ventilation Holes or devices used for free circulation of air entering and exiting.

2.29 Weighing Instrument A measuring instrument used to determine the mass of agricultural commodities by utilizing gravity acting on the agricultural commodities.

2.30 Racking System Equipment systems in the warehouse which can be in the form of regular iron racks intended to increase storage capacity in a warehouse and facilitate the storage and retrieval process of products in the warehouse.

2.31 Hand Pallet A device made of iron plates with two forks that function as load bearings and use a hydraulic system to lift loads manually or electrically.

2.32 Hand Stacker A device made of iron plates with two forks that function as load bearings and use a hydraulic system to lift loads manually or electrically with a minimum lifting height of 1.5 m.

2.33 Canopy Roof on the porch located above the warehouse door.

2.34 Veranda (Teritis) Area on the outside of the building that is shaded by a roof.

2.35 Alarm/Danger Sign Signals, sounds, lights, etc., designed to warn of fire hazards, earthquakes, or other dangers.

2.36 Clean Free from dirt that can interfere with health, affect the quality of stored commodities, and/or pollute the environment.

3. CAS Warehouse Requirements in the Warehouse Receipt System

3.1 Location Requirements

The warehouse location must meet the following requirements: a. Near or on the edge of a special class, I, II, III road, or other access via waterways to facilitate entry and exit of the warehouse area, thereby ensuring the smoothness of loading/unloading and distribution activities. b. Free from and safe from floods and landslides. c. Far from hazardous chemical plants or warehouses, public fuel filling stations, and/or garbage/chemical waste disposal sites. d. Separated from other surrounding buildings so that the security and safety of stored commodities are more guaranteed. e. Not located on former garbage dumps and/or former chemical plants.

3.2 Building Technical Requirements

3.2.1 Construction and Building Materials

The construction and building materials of CAS warehouses in the Warehouse Receipt System must meet the following requirements: a. The warehouse structure must be strong against self-load, commodity load, external loads (wind, rain, earthquake, humans, etc.) so as to guarantee human safety and commodity quality. b. The warehouse roof must be made of material that is strong enough and leak-proof. c. The warehouse building walls must be strong. d. The warehouse floor must be made of concrete or other strong material to withstand the weight of stored goods according to the maximum warehouse capacity, free from groundwater seepage, and have a flat surface. e. Doors must be made of strong, durable material and equipped with strong locks, and have canopies to guarantee the smoothness of agricultural commodity entry and exit. f. The warehouse building must have a veranda around the building with sufficient width to minimize rainwater hitting the warehouse walls. g. CAS warehouse wall buildings must be made of material with a low heat conduction value with a minimum insulation panel thickness of 100 (one hundred) mm. h. Insulation material in insulation panels consists of polyurethane or polyisocyanurate or other insulation materials. i. The skin of insulation panels must have anti-rust material. j. CAS warehouse insulation ceiling panels must be strong, not cracked, airtight, rust-resistant, free from hazardous chemicals, waterproof, and safe from weather influences. k. CAS warehouse insulation wall panels must be strong, not cracked, airtight, rust-resistant, free from hazardous chemicals, waterproof, and safe from weather influences. l. The CAS warehouse floor is based on an insulated slab or polyurethane panel or other insulation material coated with strong concrete to withstand the weight of stored commodities according to the maximum warehouse capacity, free from groundwater seepage, and have a flat surface. m. CAS warehouse doors must be made of strong, durable, airtight, anti-rust material, and equipped with inspection windows. n. Equipped with adequate weatherproof lighting lamps to support activities inside the CAS warehouse.

3.2.2 Atmospheric Control System

Has a system for controlling room temperature, humidity, and air content consisting of refrigerators, humidifiers, air content controllers including O2, CO2, and N2, and Ethylene.

3.2.3 Warehouse Facilities

CAS warehouses have supporting facilities that function well, as follows: a. Water and electrical installations with guaranteed supply to support CAS warehouse operations. b. Lightning arresters. c. Offices or administrative rooms equipped with facilities and infrastructure supporting warehouse manager work. d. Communication network access in the form of telephone and internet (fixed-line or wireless) that can support operational work. e. Water channels that are maintained so that water can flow well to avoid waterlogging. f. Security systems, guard rooms, and strong fences around the building. g. Courtyards or parking areas with sufficient width. h. Bathrooms and toilets. i. Adequate generators as backup power sources when the main source is disconnected. There is a switch to manually control the use of electricity and generators. j. Signs or prohibition signs, including health signs, occupational safety signs, evacuation routes, and assembly points. k. Adequate lighting lamps. l. Closed-circuit television (CCTV) that functions adequately in number to monitor activities in the warehouse area, and can only be accessed by authorized parties.

3.2.4 Warehouse Equipment

The warehouse must have the following equipment: a. Weighing instruments that have been officially sealed and are still valid to measure the weight of agricultural commodities. b. Racking System can use iron racks to facilitate stacking goods in CAS warehouses. c. Hygrometers and thermometers that are still functioning to measure humidity and air temperature in the warehouse. d. Work aids in the form of hand pallets/hand stackers that are safe for agricultural commodities. e. Active fire extinguishing equipment that is not expired in adequate numbers as first responders in case of fire, which can be in the form of Portable Fire Extinguishers (APAR) and/or hydrants. f. Safety equipment consisting of 1 set of 1 m3 filled and usable Oxygen cylinders with masks, Helmets, and First Aid Kits (P3K) equipped with sufficient medicines and equipment. g. Cleaning equipment that guarantees the cleanliness of the warehouse, facilities and infrastructure, and its environment. h. Alarm/danger signs.

4. Classification of CAS Warehouses in the Warehouse Receipt System

The classification of CAS warehouses in the Warehouse Receipt System based on the fulfillment of general and technical requirements is grouped into 3 (three), namely Warehouse A, B, and C. The complete warehouse classification is contained in Table 1.
