Circular 001/2015 on the Submission of Periodic Financial Statements by Credit Institutions

The Central Bank of the Comoros issues Circular 001/2015 to mandate credit institutions to submit monthly and annual financial statements using prescribed models. Non-compliance with these reporting obligations subjects institutions to sanctions under Law 13-003/AU. This circular supersedes the previous 2009 regulation and entered into force upon its signature on January 28, 2015.

CIRCULAR No. 001/2015/BCC/DSBR

REGARDING THE SUBMISSION OF PERIODIC FINANCIAL STATEMENTS BY CREDIT INSTITUTIONS IN APPLICATION OF REGULATION No. 006/2015/BCC/DSBR

Having regard to Law 80-08 of June 26, 1980, relating to currency and the role of the Central Bank of the Comoros in the control of banks and financial establishments, credit, and foreign exchange;

Having regard to Law 13-003/AU regulating banking and financial activities, in its articles 26, 29, 46, and 103;

Having regard to Law 12-008/AU of June 28, 2012, combating money laundering and the financing of terrorism;

Having regard to Law 12-011/AU of June 26, 2012, regulating and organizing credit leasing;

Having regard to the regulation relating to periodic financial statements to be submitted by credit institutions, in its Article 1;

THE GOVERNOR OF THE CENTRAL BANK OF THE COMOROS;

Sets the rules regarding the submission of periodic financial statements by credit institutions.

Article 1.- A financial statement conforming to the model attached as an annex is prepared monthly by credit institutions.

Article 2.- An annual income statement presented according to the model provided in the annex is prepared annually by all subject establishments.

Article 3.- Failure to submit the declarative statements required by Articles 1 and 2 is subject to the sanctions provided for by Law 13-003/AU, notably in its articles 61, 62, 63, 64, 65, and 66.

Article 5.- This circular annuls and replaces Circular No. 001/2009/COB of January 26, 2009.

It enters into force as of its date of signature.
