The Superintendent of Banking, Insurance and Private Pension Fund Administrators (SBS) has approved a modification to Article 14 of the Statute of the Cooperative Deposit Insurance Fund (FSDC). This change stipulates that in the event of the President's temporary absence, the SBS representative will substitute, assuming all functions and attributions mentioned in Article 25 of the Statute. This resolution, requested by the FSDC and agreed upon by its Administrative Council, ensures continuity in leadership for the fund established to protect deposits in Savings and Credit Cooperatives.
Los Laureles Nº 214 - Lima 27 - Peru Tel. : (511)6309000 Lima, October 09, 2025 SBS RESOLUTION N° 03625-2025 The Superintendent of Banking, Insurance and Private Pension Fund Administrators HAVING SEEN: The request submitted by the Cooperative Deposit Insurance Fund, through Memorandum N° 00013-2025-FSDC dated 10.09.2025, for the approval of the partial modification of its Statute; and; WHEREAS: WHEREAS, Law N° 30822 modified the General Law of the Financial System and the Insurance System and Organic Law of the Superintendency of Banking and Insurance, Law N° 26702 and its modifying norms (General Law), replacing the Twenty-Fourth Final and Complementary Provision, referring to Savings and Credit Cooperatives Not Authorized to Capture Resources from the Public (Coopac); WHEREAS, by virtue of what is established in numeral 8.1 of subsection 8 of the aforementioned Final and Complementary Provision, the Cooperative Deposit Insurance Fund (FSDC) was constituted, exclusively for Coopac, as a private law legal entity of a nature distinct from the Deposit Insurance Fund, whose main purpose is to protect those who make deposits in Coopac; WHEREAS, by means of SBS Resolution N° 0158-2020, and in accordance with the provisions of numeral 8.6 of subsection 8 of the Twenty-Fourth Final and Complementary Provision of the General Law, the Superintendency of Banking, Insurance and Private Pension Fund Administrators (Superintendency) approved the Statute of the FSDC. Likewise, the aforementioned numeral 8.6 establishes that any statutory modification must have the approval of the Superintendency; WHEREAS, in session N° 03-2025/FSDC of 27.02.2025, the Administrative Council of the FSDC unanimously agreed to modify article 14 of its Statute; WHEREAS, article 27 of the FSDC Statute establishes that modifications to the Statute shall be registered in the Public Registries solely by virtue of the approval Resolution issued by the Superintendency;
Los Laureles Nº 214 - Lima 27 - Peru Tel. : (511)6309000 Having the approval of the Assistant Superintendencies of Cooperatives and of Regulation and Legal Affairs; and, In accordance with the provisions of the Twenty-Fourth Final and Complementary Provision of the General Law; RESOLVES: Sole Article.- To approve the incorporation of the following paragraphs at the end of article 14 of the Statute of the Cooperative Deposit Insurance Fund, approved by SBS Resolution N° 0158-2020: “Article 14. Members of the Administrative Council (...) In case of temporary absence of the President, the representative of the Superintendency of Banking, Insurance and Private Pension Fund Administrators shall substitute him in the exercise of his functions, assuming all the attributions mentioned in article 25 of the Statute, for the duration of the temporary absence. Temporary absence shall be understood as any temporary situation that prevents the President from exercising the functions for which he has been designated.” Register, communicate, and transcribe the present resolution to the Public Registries for its registration.
