216 DECREES of 3 October 2014, amending Decree No. 346/2013 Coll. on the submission of reports by banks and branches of foreign banks to the Czech National Bank

The Czech National Bank, pursuant to Section 41(3) of Act No. 6/1993 Coll., on the Czech National Bank, as amended by Act No. 227/2013 Coll., has determined as follows:

Article I

Decree No. 346/2013 Coll. on the submission of reports by banks and branches of foreign banks to the Czech National Bank is amended as follows:

1. Footnote 1 reads: "1) Article 5 of Protocol (No. 4) on the Statute of the European System of Central Banks and of the European Central Bank. Council Regulation (EC) No 2533/98 of 23 November 1998 concerning the collection of statistical information by the European Central Bank, in its amended version. Regulation (EU) No 549/2013 of the European Parliament and of the Council of 21 May 2013 on the European system of national and regional accounts in the European Union. Regulation (EU) No 1071/2013 of the European Central Bank of 24 September 2013 concerning the balance sheet of the monetary financial institutions sector (recast) (ECB/2013/33). Regulation (EU) No 1072/2013 of the European Central Bank of 24 September 2013 concerning interest rate statistics of monetary financial institutions (recast) (ECB/2013/34), in its amended version. Regulation (EU) No 1409/2013 of the European Central Bank of 28 November 2013 concerning payment statistics (ECB/2013/43). Regulation (EC) No 184/2005 of the European Parliament and of the Council of 12 January 2005 on Community statistics relating to balance of payments, international trade in services and direct foreign investment, in its amended version. Regulation (EU) No 575/2013 of the European Parliament and of the Council of 26 June 2013 on prudential requirements for credit institutions and investment firms and amending Regulation (EU) No 648/2012."

2. In Section 3(1), letter b) reads: "b) within 17 days after the end of the calendar month to which they relate, these reports:

3. VT (ČNB) 1-12 'Monthly report of a bank/branch of a foreign bank on write-offs of loans and other receivables',

4. VUS (ČNB) 1-12 'Monthly report of a bank/branch of a foreign bank on interest rates on accepted deposits and loans',

5. VUS (ČNB) 2-12 'Monthly report of a bank/branch of a foreign bank on interest rates on granted loans' and

6. VUS (ČNB) 3-12 'Monthly report of a bank/branch of a foreign bank on interest rates on non-tradable debt securities',".

7. In Section 3(1), letters c), points 1 to 3 read: "1. VUS (ČNB) 11-12 'Monthly report of a bank/branch of a foreign bank on interest rates on newly accepted deposits and loans',

8. VUS (ČNB) 12-12 'Monthly report of a bank/branch of a foreign bank on interest rates on newly granted loans' and

9. VUS (ČNB) 13-12 'Monthly report of a bank/branch of a foreign bank on interest rates on non-tradable debt securities in new transactions',".

10. In Section 3(1), letter d) is repealed. Existing letters e) to h) are designated as letters d) to g).

11. In Section 3(1), letter e), points 1 to 3 are repealed. Existing points 4 to 7 are designated as points 1 to 4.

12. In Section 3(2), the words "f) to h)" are replaced by the words "e) to g)".

13. In Section 4(1), letter d), at the end of point 2, the comma is replaced by the word "and", at the end of point 3, the word "and" is replaced by a comma, and point 4 is repealed.

14. In Section 5, a new letter b) is inserted after letter a), which reads: "b) by 20 February, based on the status as of 31 December of the preceding year, the report PLS (ČNB) 10-01 'Annual report on payment transactions of a bank/branch of a foreign bank',". Existing letters b) to d) are designated as letters c) to e).

15. In Section 7, paragraph 2 is repealed. Existing paragraphs 3 to 5 are designated as paragraphs 2 to 4.

16. In Section 7, paragraph 4 reads: "(4) The report according to paragraph 3 for the 4th quarter shall be submitted by 25 March of the following year."

17. In Section 8(1), the words "f) to h)" are replaced by the words "e) to g)".

18. In Section 9(1), after the words "report Bil (ČNB) 1-12", the word "and" is replaced by a comma, and after the words "report E (ČNB) 9-01", the words "and report E (ČNB) 10-01" are inserted.

19. In Section 11(1), the words "Section 7(4)" are replaced by the words "Section 7(3)".

20. In Section 12(2), the words "Bil (ČNB) 9-12," and the words "E (ČNB) 7-04," are repealed.

21. Section 15, including the heading, reads: "Section 15 Special Provisions The report according to Section 3(1), letter g), shall be compiled by a bank and a branch of a foreign bank for the last time as of 31 March 2015."

22. In Annex No. 1, points 2, 4 to 8 and 40 are repealed. Existing point 3 is designated as point 2, existing points 9 to 39 are designated as points 3 to 33, and existing points 41 to 43 are designated as points 34 to 36.

23. In Annex No. 1, point 14, last sentence, the words "relations with clearing counterparties and with specialized institutions for asset securitization" are replaced by the words "liabilities to clearing counterparties, specialized institutions for asset securitization and trust funds".

24. In Annex No. 1, point 15, first sentence, the word "individual" is inserted after the words "on the status".

25. At the end of Annex No. 1, point 37 is added, which reads: "37. PLS (ČNB) 10-01 'Annual report on payment transactions of a bank/branch of a foreign bank' The report contains data on the number and type of accounts held for clients, on the number of devices accepting payment cards (hereinafter referred to as 'acceptance devices') classified by their type and country of location, on the number and type of issued payment cards and on the number and volume of payment transactions carried out on them, on the number and volume of client transactions by type of payment service in geographical classification, on the number and volume of payment transactions carried out on acceptance devices classified by card issuer, by type of payment transaction carried out by card in further geographical classification by country of location and operator of the acceptance device, and data on the number and volume of cash client transactions carried out at the counter of the reporting bank/branch of a foreign bank or with a merchant."

Article II

Effectiveness This decree shall enter into force on 1 January 2015.
