Given the need to establish the legal framework governing the establishment and operation of entities providing credit and payment information management services under paragraph 1 of Article 179 of the Constitution, the Assembly of the Republic determines:
General Provisions
ARTICLE 1 (Object)
This Law establishes the Private Management Credit Information System in Mozambique and sets forth its operational rules.
The system referred to in paragraph 1 of this Article comprises the set of private management credit information centers, their operational processes, data providers, subscribers, and clients.
ARTICLE 2 (Scope of Application)
This Law applies to credit information centers, data providers, subscribers, and clients.
ARTICLE 3 (Definitions)
The definitions of the terms used in this Law are contained in the Glossary attached hereto, which forms an integral part hereof.
Licensing
ARTICLE 4 (Mandatory Licensing)
The establishment of credit information centers is subject to prior licensing by the Bank of Mozambique.
The license granted by the Bank of Mozambique is non-transferable and non-negotiable.
ARTICLE 5 (License Application)
The license application must be accompanied by documents proving: a) the suitability of the applicants; b) the financial capacity of the applicants, to ensure the stability of the Credit Information Center; c) the feasibility of the project.
The Regulations of this Law specify the information, documents, and procedures required for processing the license application.
ARTICLE 6 (License Expiry)
The license expires if: a) the institution is not established within six months from the date of authorization; b) the institution does not commence operations within twelve months from the date of authorization; c) the applicants expressly waive it before the commencement of operations.
