Issued by the Head of Government of Algeria, this executive decree implements Article 61 of Legislative Decree No. 93-10 by defining the categories of legal entities eligible for temporary approval as stock exchange intermediaries. The decree authorizes the Commission for the Organization and Supervision of Stock Exchange Operations to grant this status to banks, financial institutions, insurance companies, and participation funds regularly established in Algeria. The regulation came into force on June 13, 1994, and was published in the Official Journal of the People's Democratic Republic of Algeria.
The Head of Government;
Having seen the Constitution, particularly its Articles 81-4 and 116 (paragraph 2);
Having seen the platform establishing national consensus on the transitional period;
Having seen Ordinance No. 66-156 of June 8, 1966, as amended and supplemented, establishing the Penal Code;
Having seen Ordinance No. 75-58 of September 26, 1975, as amended and supplemented, establishing the Civil Code;
Having seen Ordinance No. 75-59 of September 26, 1975, as amended and supplemented, establishing the Commercial Code;
Having seen Law No. 80-07 of August 9, 1980, relating to insurance;
Having seen Law No. 88-03 of January 12, 1988, relating to participation funds;
Having seen Law No. 90-10 of April 14, 1990, relating to currency and credit;
Having seen Legislative Decree No. 93-10 of May 23, 1993, relating to the securities exchange;
Having seen Presidential Decree No. 94-92 of 30 Chaoual 1414 corresponding to April 11, 1994, appointing the Head of Government;
Having seen Presidential Decree No. 94-93 of 4 Daou El Kaada 1414 corresponding to April 15, 1994, appointing the members of the Government;
Decrees:
Article 1. — In application of Article 61 of Legislative Decree No. 93-10 of May 23, 1993, cited above, the purpose of this decree is to define the categories of legal entities that may be approved, on a temporary basis, by the Commission for the Organization and Supervision of Stock Exchange Operations as stock exchange intermediaries.
Art. 2. — The following may be approved, on a temporary basis, by the Commission for the Organization and Supervision of Stock Exchange Operations, as stock exchange intermediaries: banks, financial institutions, and insurance companies, regularly established in Algeria, as well as participation funds.
Art. 3. — This decree shall be published in the Official Journal of the People's Democratic Republic of Algeria.
