The Croatian Financial Services Supervisory Agency (HANFA) issued instructions effective January 1, 2023, mandating that factoring companies submit annual and quarterly financial, additional, and capital calculation reports in electronic XML format. The directive specifies distinct XML file structures for active and liquidated entities, requiring digital signatures by at least two management board members or authorized proxies. This regulation supersedes the previous technical instruction from 2017 to standardize the electronic reporting process.
Based on Article 7, Paragraph 1 of the Rulebook on Financial and Additional Reports and the Chart of Accounts for Factoring Companies ("Narodne novine" No. 41/16, 61/16, and 142/22) and Article 5, Paragraph 5 of the Rulebook on the Capital of Factoring Companies ("Narodne novine" No. 12/15 and 142/22), the Croatian Financial Services Supervisory Agency (HANFA) at the meeting of the Board of Directors held on December 21, 2022, adopts
A factoring company is obliged to submit annual and quarterly financial and additional reports of the factoring company to the Croatian Financial Services Supervisory Agency (hereinafter: the Agency) in accordance with the Rulebook on Financial and Additional Reports and the Chart of Accounts for Factoring Companies ("Narodne novine" No. 41/16, 61/16, and 142/22; hereinafter: the Rulebook) as well as the annual and quarterly report on the calculation of the capital of the factoring company in accordance with the Rulebook on the Capital of Factoring Companies ("Narodne novine" No. 12/15 and 142/22; hereinafter: the Capital Rulebook).
These Instructions regulate the format and method of submission of the aforementioned factoring company reports in electronic form.

Reports are submitted in electronic form in the following format and files:
An XML format file encompassing a set of annual reports of factoring companies in accordance with the prescribed XML schema published on the Agency's website, signed by the Management of the company (G-FAKTORING). This file constitutes a set of annual financial and additional reports from the Rulebook and the annual report on capital calculation from the Capital Rulebook.
An XML format file encompassing a set of quarterly reports of factoring companies in accordance with the prescribed XML schema published on the Agency's website, signed by the Management of the company (T-FAKTORING). This file constitutes a set of quarterly financial and additional reports from the Rulebook and the quarterly report on capital calculation from the Capital Rulebook.
An XML format file encompassing a set of annual reports of factoring companies in liquidation in accordance with the prescribed XML schema published on the Agency's website, signed by the liquidator of the factoring company (G-FAKTORING-LIK). This file constitutes a set of annual financial and additional reports from the Rulebook, which factoring companies in liquidation are obliged to submit to the Agency based on the Rulebook on the Application of Provisions of the Factoring Act and Other Regulations to Factoring Companies in Liquidation ("Narodne Novine" No. 52/15 and 142/22).
An XML format file encompassing a set of quarterly reports of factoring companies in liquidation in accordance with the prescribed XML schema published on the Agency's website, signed by the liquidator of the factoring company (T-FAKTORING-LIK).
2 This file constitutes a set of annual financial and additional reports from the Rulebook, which factoring companies in liquidation are obliged to submit to the Agency based on the Rulebook on the Application of Provisions of the Factoring Act and Other Regulations to Factoring Companies in Liquidation ("Narodne Novine" No. 52/15 and 142/22).
Factoring companies are obliged to create report files in XML format in accordance with the prescribed XML schema of the Agency. XML schemas for the preparation of factoring company reports are available on the HANFA website (http://reports.hanfa.hr/Documentation). Factoring companies will independently determine the method by which they will enter data from the aforementioned forms into the XML report, and are responsible for its preparation in accordance with the prepared XML schema.
The signing of files, which the factoring company is obliged to submit, is carried out in accordance with the valid Technical Instruction for the Application of Electronic Signature in the Reporting Procedure of the Croatian Financial Services Supervisory Agency, published on the Agency's website. The signing rules are the same as the rules applicable to the handwritten signature applied to the written form of the report. Factoring company reports are signed by at least two members of the management board of the factoring company. Exceptionally, in case of impediment, the management board of the factoring company may, in accordance with regulations on representation, authorize another person in writing to sign reports with prior notice to the Agency.
Factoring companies submit the reports from point 2 of these Instructions in accordance with the valid Technical Instruction for Reporting and Working with the Interface of the System for Data Submission in Electronic Form, published on the Agency's website.
With the application of these Instructions, the Technical Instruction for the Preparation and Submission of Factoring Company Reports in Electronic Form from January 27, 2017, ceases to be valid. These Instructions enter into force on January 1, 2023.
