Notice No. 17/GBM/2017, of August 24 – Exonerates the Provisional Board of Directors Appointed to Manage Moza Banco, S.A. within the Framework of Extraordinary Sanitation Measures

The Bank of Mozambique issued Notice No. 17/GBM/2017 to formally exonerate the five members of the Provisional Board of Directors managing Moza Banco, S.A., following the resolution of extraordinary financial and prudential sanitation measures. Effective immediately, this notice revokes three prior 2016–2017 appointments and directs that any interpretative disputes be submitted to the bank's Regulation and Licensing Department. In parallel, the Ministry of Science and Technology established six new district delegations for the Research and Technology Transfer Center (CITT) across five provinces, transferring existing research resources to drive local agricultural productivity, technology transfer, and sustainable community development.

Thursday, August 24, 2017 I SERIES — Number 133 MINISTRY OF SCIENCE AND TECHNOLOGY, HIGHER EDUCATION AND TECHNICAL TRAINING Ministerial Decree No. 52/2017 of August 24 Given the need to ensure the development of activities of the Research and Technology Transfer Center for Community Development (CITT), created by Decree No. 36/2010 of September 1, in a direct and presential manner, and given that its Article 2 provides for the creation of Delegations anywhere in the national territory combined with existing infrastructure and some human resources, the Minister of Science and Technology, Higher Education and Technical Training determines:

  1. The District Delegations of the Research and Technology Transfer Center for Community Development are established in the following locations: • Angoche District – Nampula Province; • Angónia District – Tete Province; • Bárue District – Manica Province; • Manica District – Manica Province; • Caia District – Sofala Province; and • Mandlakazi District – Gaza Province.
  2. The existing material, financial and patrimonial resources in the Research and Technology Transfer Poles for Increasing Rice, Corn and Wheat Productivity are transferred to their respective District Delegations of the CITT, without further formalities. This Ministerial Decree enters into force on the date of its publication. Ministerial Decree No. 53/2017 of August 24 Given the need to operationalize the District Delegations of the Research and Technology Transfer Center for Community Development, hereinafter referred to as CITT, created under Article 2 of Decree No. 36/2010 of September 1, the Minister of Science and Technology, Higher Education and Technical Training determines: Single Article. The Type Internal Regulation of the District Delegations of the Research and Technology Transfer Center for Community Development of Angoche, Angónia, Bárue, Manica, Caia and Mandlakazi, attached hereto, is approved, forming an integral part of this Ministerial Decree. 942 I SERIES — NUMBER 133 Type Internal Regulation of the District Delegation of the Research and Technology Transfer Center for Community Development CHAPTER I General Provisions Article 1 (Nature and Scope) The District Delegation of the Research and Technology Transfer Center for Community Development is a public institution subordinate to the Research and Technology Transfer Center for Community Development (CITT) at the district level. Article 2 (Functions) The functions of the District Delegation of the Research and Technology Transfer Center for Community Development are as follows: a) Ensure, in coordination with communities, the development of scientific research activities for local benefit; b) Ensure technological development, knowledge transfer, local cultures and technologies generated by the CITT and other sectors to the local community and vice versa; c) Ensure technological promotion and development, innovation and entrepreneurship within communities through the process of technology and business incubation; d) Promote and develop innovations and their diffusion as alternatives for solving community problems and sustainable community development; e) Promote intersectoral collaboration at the district level in research and technology transfer for community development; f) Promote the increase in production and productivity of agricultural crops and livestock, through the use of technologies according to the district's agro-ecological conditions. CHAPTER II Bodies Article 3 (Bodies) The following bodies operate within the District Delegation: a) Direction Council; b) Technical Council. Article 4 (Direction Council)

  1. The Direction Council is a consultative body convened and directed by the District Delegate, with the following functions: a) Analyze and advise on the organization, programs and projects within the context of the delegation's assignments and competencies; b) Analyze and issue opinions on project plans and budgets of the delegation's activities; c) Review and issue opinions on reports and balance sheets regarding the execution of the delegation's plan and budget; d) Advise the direction of the District Delegation regarding issues impacting the delegation as well as communities; e) Comment on training, research and technology transfer results; f) Comment on other matters related to the assignments and competencies of the District Delegation; and g) Advise the District Delegate on other matters aimed at the normal functioning of the delegation.
  2. The Direction Council is composed as follows: a) District Delegate; and b) Heads of District Departments.
  3. Other technicians designated by the District Delegate may be invited to participate in Direction Council meetings, depending on the subject matter.
  4. The Direction Council meets ordinarily every fifteen days and extraordinarily whenever convened by the District Delegate. Article 5 (Technical Council)
  5. The Technical Council is the consultative body on technical-scientific matters of the District Delegation, convened and directed by the District Delegate, with the following functions: a) Advise the Direction of the District Delegation regarding technical-scientific issues impacting the delegation and communities; b) Gather sensitivities from other actors on technical-scientific matters aimed at materializing the delegation's assignments and competencies; c) Ensure compliance with technical and technological standards and procedures applicable to the delegation; d) Promote technical-scientific cooperation, research and technology transfer; e) Comment on research programs focused on community development; f) Comment on technology transfer programs for community development; g) Propose to the District Delegation possible amendments to be introduced in training, research or technology transfer programs; h) Comment on training, research and technology transfer results; i) Ensure the implementation of professional, academic internship programs, as well as the preparation of theses and/or dissertations; j) Comment on other technical-scientific matters related to the delegation's assignments and competencies.
  6. The Technical Council is convened and directed by the District Delegate.
  7. The Technical Council is composed as follows: a) District Delegate; b) Head of the District Planning and Research Department; c) Two Representatives from Higher Education and Technical Training Institutions existing in the district, one representative from each area; d) One Representative from the sector overseeing Science and Technology in the District; e) One Representative from Research Institutions;

24 DE AGOSTO DE 2017 943 f) One Representative from the District Economic Activities Services (SDAE); g) Two Representatives of Farmers; h) One Representative from Non-Governmental Organizations (NGOs); i) One Representative from Financial Institutions; j) Two Representatives of local communities; k) One Representative from Local Economic Agents. 4. Other technicians designated by the District Delegate may be invited to participate in Technical Council meetings, depending on the subject matter. 5. The Technical Council meets ordinarily four times a year and extraordinarily whenever convened by the Delegate. CHAPTER III Organizational Structure Article 6 (Structure) The District Delegation of the CITT has the following structure: a) Direction; b) Planning and Research Department; c) Operations and Technology Transfer Department; d) Administration, Finance and Human Resources Department. Article 7 (Direction) The District Delegation of the Research and Technology Transfer Center for Community Development is directed by a District Delegate, appointed by the Director of the CITT. Article 8 (Competencies of the Delegate) The District Delegate is responsible for: a) Submitting to the CITT, with the consent of the District Administrator, policies, standards, regulations, administrative and financial procedures regarding the District Delegation; b) Ensuring delegation management in human resources, financial, patrimonial and general support services areas; c) Representing the delegation whenever necessary; d) Ensuring the correct execution of the Delegation's Programs and Projects; e) Exercising other competencies assigned by the CITT. CHAPTER III Functions of Organizational Units Article 9 (Planning and Research Department)

  1. The functions of the Planning and Research Department are: a) Develop the planning process necessary for the normal functioning of the District Delegation; b) Monitor and analyze the implementation of operational plans and their impact on communities; c) Promote, coordinate, develop and execute scientific and technological research programs and projects to solve community problems; d) Investigate, develop and disseminate the use of natural resources, excluding mineral resources; e) Identify and test appropriate technologies for production, drying, storage, processing and quality control of seeds and grains; f) Develop technological packages for crops adapted to the district's agro-ecological conditions.
  2. The Planning and Research Department is directed by a District Department Head, appointed by the Director of the CITT, upon proposal of the District Delegate. Article 10 (Operations and Technology Transfer Department)
  3. The functions of the Operations and Technology Transfer Department are: a) Ensure the preparation and implementation of programs and projects directed at technology transfer to solve community problems; b) Ensure the creation of collective use spaces to develop practical know-how; c) Disseminate the use of alternative technologies useful for community development through publications, training courses, social workshops, seminars, internships and life experiences; d) Mobilize resources and partnerships for the development of the District Delegation's activities; e) Ensure the dissemination of the use of alternative technologies useful for community development; f) Promote sustainable use of natural resources. g) Ensure the transfer of technological packages, equipping producers with appropriate knowledge and techniques to increase productivity of agricultural crops and livestock; h) Conduct training actions for producers, extension workers, agrarian technicians, teachers and students from Higher Education and Technical Training Institutions in various areas, with emphasis on Agricultural Mechanization; Agro-processing; Post-Harvest Management; and Agribusiness.
  4. The Operations and Technology Transfer Department is directed by a District Department Head, appointed by the Director of the CITT, upon proposal of the District Delegate. Article 11 (Administration, Finance and Human Resources Department)
  5. The functions of the Administration, Finance and Human Resources Department are: a) Within the scope of Administration and Finance i) Prepare the proposal for the activity plan and budget; ii) Ensure execution and guarantee legality and efficiency in expenditure realization; iii) Manage financial, material and patrimonial resources; iv) Ensure security, maintenance and use of the institution's facilities; v) Prepare the annual budget execution balance sheet and submit it to the CITT with the knowledge of the District Government; vi) Keep updated files of acquired patrimonial assets; vii) Ensure the reception, circulation and dispatch correspondence system as well as the bookkeeping of mandatory books.

944 I SERIES — NUMBER 133 b) Within the scope of Human Resources i) Ensure compliance with the General Statute of State Employees and Agents and other applicable legislation; ii) Manage the Staffing Table of the District Delegation; iii) Plan, control and implement human resource management standards according to government policy and plans; iv) Implement the training and human resource development policy; v) Ensure performance evaluation of state employees and agents; vi) Organize, control and keep the e-SIP updated according to guidelines and standards defined by competent bodies; vii) Coordinate activities regarding the implementation of strategies to combat HIV and AIDS, Gender and Persons with Disabilities in public service. 2. The Administration, Finance and Human Resources Department is directed by a District Department Head appointed by the Director of the CITT, upon proposal of the District Delegate. CHAPTER V Final Provisions Article 12 (Staffing Table) The Minister overseeing the Science and Technology area is responsible for submitting the Staffing Table proposal for the CITT District Delegations to the approval of the competent body, within ninety days counted from the publication of this Internal Regulation. BANK OF MOZAMBIQUE Notice No. 17/GBM/2017 of August 24 Given the need to reinforce the extraordinary sanitation measures imposed on Moza Banco, S.A., as a result of the worsening deterioration of its financial and prudential situation, the Bank of Mozambique appointed a Provisional Board of Directors to manage that institution through Notice No. 3/GBM/2016 of November 14, which was updated by Notice No. 1/GBM/2017 of February 16, and by Notice No. 3/GBM/2017 of April 20. Having ceased the reasons that dictated the adoption of said measure, the Bank of Mozambique, under Articles 81 and 84 of Law No. 15/99 of November 1 – Credit Institutions and Financial Companies Law, with amendments introduced by Law No. 9/2004 of July 21, determines: Article 1. The members of the Provisional Board of Directors of Moza Banco, S.A., are exonerated, namely: a) João Filipe Figueiredo Júnior – President; b) Joana Jacinto David Matsombe – Administrator; c) Sérgio Eduardo Ribeiro – Administrator; d) Vítor Manuel Latas Brazão – Administrator; e) Manuel Duarte Emauz de Vasconcelos Guimarães – Administrator. Art. 2. This Notice enters into force immediately and revokes Notices No. 3/GBM/2016 of November 14, No. 1/GBM/2017 of February 16, and No. 3/GBM/2017 of April 20. Art. 3. Doubts arising from the interpretation and application of this Notice shall be submitted to the Regulation and Licensing Department of the Bank of Mozambique.
