Circular No. 3 of 2024 Date: 20th August 2024 Access within a demarcated International Trade Zones Reference is made to section 4(3) the International Trade Zone (ITZ) Act, 1995 which stipulates the following: 4(3). The Authority or an officer or agent of the Authority, the Comptroller of Trades Tax Import or an officer authorised by the Comptroller of Trades Tax Imports or a police officer may, without a warrant, stop and search a person, vehicle or vessel entering or leaving a zone and seize and detain any goods found on the person, vehicle or vessel and reasonably suspected of being brought into or taken out of the zone in contravention of this Act. Further reference to section 6(1) (b) of the International Trade Zone Regulation which states: 6(1). For the exercise of its functions; (b) the Trades Tax Imports Division may establish a branch office of the Division in a zone. Based on the above legal provisions, the Financial Services Authority (FSA) is informing all ITZ licensees of their obligation to permit its officers or authorized officers of the Seychelles Revenue Commission (SRC) to access their demarcated zones to perform their duties under the International Trade Zone Act and Customs Management Act respectively. The FSA counts on the continued cooperation of licensees in maintaining access within a zone upon entry by FSA and SRC officers whereby failure to do so may result in enforcement action.
