Decision on the obligation to apply the Guidelines on reporting of internalised settlements in accordance with Article 9 of CSDR (ESMA 70-151-367)

The Croatian Financial Services Supervisory Agency (Hanfa) issued this Decision to mandate the application of ESMA's Guidelines on reporting of internalised settlements under Article 9 of CSDR for its competent authorities and settlement internalisers. The Decision formally aligns Hanfa's regulatory framework with the 30 April 2019 ESMA guidelines and establishes binding reporting obligations for designated market participants. It enters into force on 22 August 2019 following publication on Hanfa's official website.

Based on Article 15(1) of the Act on the Croatian Financial Services Supervisory Agency (Official Gazette nos. 140/05 and 12/12) and Article 14(3) of the Act on the Implementation of Regulation (EU) No 909/2014 on improving securities settlement in the European Union and on central securities depositories (Official Gazette no. 44/16), the Management Board of the Croatian Financial Services Supervisory Agency (hereinafter: Hanfa) at its meeting held on 22 August 2019 hereby adopts the following

D E C I S I O N on the obligation to apply the Guidelines on reporting of internalised settlements in accordance with Article 9 of CSDR (ESMA 70-151-367)

I. On 28 June 2019, Hanfa adopted the Decision on alignment with the Guidelines on reporting of internalised settlements in accordance with Article 9 of CSDR, reference ESMA 70-151-367, dated 30 April 2019, and notified the European Securities and Markets Authority (ESMA) thereof.

II. The application of the Guidelines referred to in point I of this Decision is mandatory for the competent authorities established in Article 11 of CSDR (Hanfa and HNB) and for settlement internalisers established in Article 2(1)(11) of CSDR.

III. This Decision shall be published on Hanfa's website and enters into force on 22 August 2019.
