Instruction No. 234 on the Procedure for Import and Export of Currency Values in the Republic of Tajikistan

Instruction No. 234 "On the Procedure for Import into and Export from the Republic of Tajikistan of Currency Values" Instruction No. 234 "On the Procedure for Import into and Export from the Republic of Tajikistan of Currency Values" is developed in accordance with Article 10 of the Law of the Republic of Tajikistan "On Currency Regulation and Currency Control" and establishes the procedure for importing into the Republic of Tajikistan and exporting and mailing from the Republic of Tajikistan by natural persons (residents and non-residents) and authorized banks of cash national currency, cash foreign currency, bearer instruments, and securities expressed in documentary form in national and foreign currencies.

CHAPTER 1. GENERAL PROVISIONS

1. The following main terms are used in this Instruction:

• cash national currency – somoni in the form of banknotes and metallic coins of the National Bank of Tajikistan;
• cash foreign currency – national currencies of foreign states in the form of banknotes (banknotes of the central (national) bank of a foreign state) and metallic coins;
• currency values – foreign currency, securities, and payment documents expressed in foreign currency, as well as national currency, securities, and payment documents expressed in national currency only when conducting transactions between residents and non-residents or between non-residents;
• payment system – a set of organizations interacting according to the rules of the payment system for the purpose of transferring funds; "Registered" Ministry of Justice Republic of Tajikistan No. 153 "b" on 05.06.2018 "Approved" Resolution of the Board National Bank of Tajikistan No. 30 dated 15.03.2018 Agreed with Customs Service under the Government of the Republic of Tajikistan Head ____ Karimzoda H.A.

• authorized bank – a credit organization conducting transactions with foreign currency based on a license of the National Bank of Tajikistan;
• import of currency values – import across the customs border of the Republic of Tajikistan to the territory of the Republic of Tajikistan of cash foreign currency, cash national currency, securities expressed in documentary form, and payment instruments in national and foreign currencies;
• export of currency values – export across the customs border of the Republic of Tajikistan from the territory of the Republic of Tajikistan of cash foreign currency, cash national currency, securities expressed in documentary form, and payment instruments in national and foreign currencies;
• mailing (delivery) of currency values – mailing from the Republic of Tajikistan or import into the Republic of Tajikistan, receipt, transportation (delivery), delivery (transfer) of cash foreign currency, cash national currency through the services of state postal organizations;
• transfer of currency values – mailing of funds and foreign currency through money transfer systems and authorized banks;
• securities in national and foreign currencies expressed in documentary form – payment documents (checks, promissory notes, drafts, letters of credit, payment orders, applications and other payment instructions, etc.), securities (shares, promissory notes, bonds, certificates on currency transactions "futures" and "options", etc.), as well as other debt obligations (deposit and savings certificates, guarantee letters, etc.);
• main (predicate) offenses – offenses provided for in the Criminal Code of the Republic of Tajikistan preceding the legalization (money laundering) of income obtained through criminal means, offenses as a result of which income is received.

CHAPTER 2. IMPORT INTO AND EXPORT FROM THE REPUBLIC OF TAJIKISTAN OF CURRENCY VALUES BY NATURAL PERSONS (RESIDENTS AND NON-RESIDENTS) 2. The export of cash currency values by natural persons (residents and non-residents) from the Republic of Tajikistan is carried out as follows:

• natural persons-residents and non-residents may freely, without mandatory written declaration and without presenting documents confirming the source of origin of currency values that serve as the basis for exporting currency values from the Republic of Tajikistan, simultaneously export currency values in an amount equivalent to 3,000 (three thousand) US dollars;
• export from the Republic of Tajikistan of currency values in an equivalent amount from 3,001 (three thousand one) US dollars to an amount equivalent to 10,000 (ten thousand) US dollars is carried out by natural persons-residents subject to mandatory written declaration, without presenting documents confirming their source of origin that serve as the basis for exporting currency values from the Republic of Tajikistan;
• export from the Republic of Tajikistan of currency values exceeding in equivalent 10,000 (ten thousand) US dollars is carried out by natural persons-residents subject to mandatory written declaration and presenting documents confirming the source of origin of currency values that serve as the basis for exporting currency values from the Republic of Tajikistan;
• export from the Republic of Tajikistan of currency values in an equivalent amount exceeding 3,000 (three thousand) US dollars by natural persons-non-residents is carried out subject to mandatory written declaration and presenting documents confirming the source of origin of currency values that serve as the basis for exporting cash foreign currency from the Republic of Tajikistan.

3. The import of currency values by natural persons (residents and non-residents) into the Republic of Tajikistan is carried out without restrictions, subject to compliance with the customs legislation of the Republic of Tajikistan.
4. Natural persons (residents and non-residents) may also voluntarily declare and carry out the export of currency values across the customs border of the Republic of Tajikistan in an amount equivalent to up to 3,000 (three thousand) US dollars.
5. The export and import of currency values across the customs border of the Republic of Tajikistan by couriers, postal shipments, freight transport and/or other types of transportation are subject to declaration in compliance with the requirements of paragraphs 2-4 of this Instruction.
6. Documents confirming the source of origin of currency values that serve as the basis for exporting currency values from the Republic of Tajikistan are:

• a customs declaration issued by customs authorities and confirming the fact of import by a natural person (residents and non-residents) into the Republic of Tajikistan of currency values;
• a document confirming the completion of exchange and/or conversion transactions with foreign currency issued to natural persons (residents and non-residents) by authorized banks (their branches) or their structural subdivisions upon sale of cash foreign currency to them;
• a document confirming the completion of currency transfer transactions issued to natural persons (residents and non-residents) by authorized banks (their branches) or their structural subdivisions upon issuance of transferred funds without opening a bank account;
• a cash disbursement order issued to the client by authorized banks (their branches) or their structural subdivisions upon withdrawal or issuance of cash national currency from an account or foreign currency account;
• a cash disbursement order issued by authorized banks (their branches) or their structural subdivisions upon issuance of cash foreign currency from the current account of a legal entity for business trip expenses of its employees and in other cases provided by legislation;
• a cash disbursement order issued by the Central Treasury of the National Bank of Tajikistan for business trip expenses of its employees and employees of budgetary organizations and agencies serviced by the Central Treasury of the Ministry of Finance of the Republic of Tajikistan.

7. Transactions for mailing (delivery) of currency values by natural persons (residents and non-residents) are carried out in accordance with the Law of the Republic of Tajikistan "On Postal Services" and other regulatory legal acts of the authorized postal authority.
8. Transactions for transferring funds are carried out by natural persons (residents and non-residents) through payment systems and international money transfer systems, and the procedure for their completion is regulated by regulatory legal acts of the National Bank of Tajikistan.

CHAPTER 3. IMPORT INTO AND EXPORT FROM THE REPUBLIC OF TAJIKISTAN OF CURRENCY VALUES BY AUTHORIZED BANKS 9. Authorized banks carry out the import into and export from the Republic of Tajikistan of currency values without limitation on amount and quantity, subject to compliance with the requirements of the customs legislation of the Republic of Tajikistan and this Instruction. The National Bank of Tajikistan, for the purpose of implementing the monetary and currency policy of the Republic of Tajikistan, has the right to carry out import into and export from the republic of currency values without limitation on amount and quantity, subject to compliance with the requirements of customs legislation. 10. The import and export of cash foreign currency by authorized banks is carried out exclusively through their correspondent accounts opened in foreign banks. The use of correspondent accounts by authorized banks of the Republic of Tajikistan in non-bank foreign institutions for crediting and withdrawing cash currency is prohibited. 11. The National Bank of Tajikistan sends to the Customs Service under the Government of the Republic of Tajikistan a list of authorized banks entitled to import and export cash currency values and any changes thereto. 12. Monthly, no later than the 10th day of the month following the reporting period, authorized banks carrying out the import into and export from the Republic of Tajikistan of currency values submit to the National Bank of Tajikistan a Report on the Import and Export of Currency Values by Credit Organizations (Appendix 1) indicating the volume of cash foreign currency and securities expressed in documentary form in national and foreign currencies imported into and exported from the Republic of Tajikistan, specifying the types of currency and securities for each shipment, as well as the numbers and dates of issuance of the corresponding cargo customs declarations. The report is accompanied by:

• copies of confirming documents on the issuance from the cash desks of authorized banks or receipt into the cash desk of currency values;
• copies of statements from correspondent accounts in foreign banks on the crediting of currency values exported from the Republic of Tajikistan or on the withdrawal from the corresponding correspondent account of currency values imported into the Republic of Tajikistan;
• a copy of a confirming document on the exchange of cash foreign currency exported from the customs border of the Republic of Tajikistan or other forms of confirming documents on currency conversion. The National Bank of Tajikistan, upon request by the Customs Service under the Government of the Republic of Tajikistan, provides a consolidated report on
