Notice No. 5/GBM/2020, of May 19 – Regarding the Obligation to Capture and Send Geographic Coordinates of Financial Services Access Points

The Bank of Mozambique issued Notice No. 5/GBM/2020 to mandate the capture, validation, and electronic archiving of georeferenced coordinates for all financial services access points. Credit institutions and financial companies must utilize applications to collect these coordinates, submit them to the Geographic Information System platform within five days of implementation or relocation, and ensure existing points are fully registered within sixty days. Compliance is enforced through the sanctions regime of Law No. 15/99, with data verification performed by personnel independent of the reporting decision-making structure to guarantee accuracy and support national financial inclusion policy.

Tuesday, May 19, 2020 | Series I — Number 94 BANCO DE MOÇAMBIQUE Notice No. 5/GBM/2020 of May 19 The National Financial Inclusion Strategy 2016-2022 establishes that the population must have an access point to financial services within five (5) kilometres of their place of residence or work, and that measures must be taken to expand and diversify financial services access points based on geospatial mapping. To achieve these objectives, it is necessary that financial services access points be captured, stored, and archived in a single electronic database, capable of being monitored and used for policy-making purposes. Accordingly, the Bank of Mozambique, exercising the competence conferred by paragraph d) of paragraph 2 of Article 37 of Law No. 1/92, of January 3, determines: CHAPTER I General Provisions Article 1 Object This Notice establishes the procedures for capturing, sending, validating, storing, and electronically archiving geographic coordinates of financial services access points. Article 2 Scope of Application This Notice applies to the following credit institutions and financial companies: a) Banks; b) Microbanks; c) Credit cooperatives; d) Electronic money institutions; e) Factoring companies; f) Investment companies; g) Leasing companies; and h) Exchange houses. Article 3 Definitions For the purposes of this Notice, the following terms are understood as: a) Branch: An establishment within the country of a credit institution or financial company with its headquarters in Mozambique, or a supplementary establishment within the country of a foreign credit institution or financial company branch, lacking legal personality and directly carrying out operations inherent to the company's activity, as amended by Law No. 15/99, of November 1, modified by Law No. 9/2004, of July 21 – Law on Credit Institutions and Financial Companies; b) Application: A set of technological tools and models that address needs related to the processing, analysis, and monitoring of institutional data; c) ATM (automated teller machine): An automated cash dispenser that allows banking operations to be performed using bank cards and other applicable methods, as defined in paragraph a) of Article 3 of Notice No. 1/GBM/2014, of June 4, amended and republished by Notice No. 10/GBM/2017, of June 7, which approves the Bank Cards Regulation; d) Database: An organized repository of data on a specific subject or theme; e) Data: A set of numerical and/or alphanumeric records; f) Tools: Instruments used for data processing; g) Geospatial: Related to the position of objects on the Earth's surface; h) Geographic Information System (GIS): An integrated system of hardware, software, data, and people used to visualize, store, manage, share, and analyze data regarding objects on the Earth's surface; i) KoBoToolbox: An open-source platform with a set of tools for collecting and/or capturing and analyzing field data; j) Map: A graphical representation of the Earth's surface; k) GIS Platform: The geographic information system of an entity; Page 576 | Series I — Number 94 l) Access points: Branches, electronic money and banking agents, ATMs, POS terminals, and others to be defined by the Bank of Mozambique, through which financial services and products currently in operation can be accessed and used; m) Inter-institutional geographic information network: An integrated structure of institutions connected to each other through a central geographic information platform accessible via the internet; n) POS (point of sale): An automated payment terminal that allows the use of bank cards to make payments or other applicable banking operations, as defined in paragraph s) of Article 3 of Notice No. 1/GBM/2014, of June 4, amended and republished by Notice No. 10/GBM/2017, of June 7, which approves the Bank Cards Regulation. CHAPTER II Capture, Storage, and Electronic Archiving of Data Related to Access Points Article 4 Obligation to Capture, Store, and Archive Data Related to Access Points

  1. All credit institutions and financial companies must capture georeferenced coordinates of financial services access points using an application.
  2. The archiving of information regarding access points must be carried out electronically and made available within the timeframe established by the Bank of Mozambique.
  3. The capture, verification, and validation of data captured using an application for upload to the GIS platform must be performed by personnel different from the decision-making structure of the credit institution or financial company that provided the information, thereby ensuring data quality and certainty.
  4. The approval for publishing captured access points by credit institutions and financial companies in the inter-institutional geographic information network of georeferenced data is carried out by the Bank of Mozambique.
  5. The terms for capturing, verifying, and validating data are established by a Circular of the Bank of Mozambique. Article 5 Submission and Data Update Period
  6. Information regarding the data must be available on the GIS platform within five days after the implementation or use of a new access point.
  7. Information regarding existing, discontinued, or relocated access points must be updated permanently.
  8. The updated information under the preceding paragraph must be communicated to the Bank of Mozambique. CHAPTER III Final Provisions Article 6 Compliance Period Existing access points must be submitted and completed on the GIS platform within sixty days, counting from the date of entry into force of this Notice. Article 7 Access Points
  9. The Bank of Mozambique may establish the timeframe and types of access points that can be captured, stored, and archived.
  10. The Bank of Mozambique may determine other typologies of access points, in accordance with paragraph l) of Article 3.
  11. For the purposes of the preceding paragraphs, the Bank of Mozambique issues the relevant Circular. Article 8 Sanctioning Regime Violation of the provisions set forth in this Notice is subject to the sanctions provided for in Law No. 15/99, of November 1, amended by Law No. 9/2004, of July 21 – Law on Credit Institutions and Financial Companies. Article 9 Entry into Force This Notice enters into force on the date of its publication. Article 10 Clarifications Doubts arising from the interpretation and application of this Notice must be submitted to the Financial Inclusion Office of the Bank of Mozambique.
