We address you to clarify that, in the case of rejection of electronic checks (ECHEQ) issued in United States dollars –within the framework of Communication A 8299 and as provided in point 6.5.1. of the consolidated text on Regulation of the Bank Current Account–, the amount of the generated fine will be converted to pesos applying the reference exchange rate (Communication A 3500) corresponding to the date of its effective payment. Regarding this, we provide you with the pages that, in replacement of those previously provided, should be incorporated into the consolidated text referenced. 6.4.9. With respect to a check presented for collection or registration against which a claim of loss, theft, or alteration is pending, as well as in the case where the bank detects this latter situation or forgery of signature, the provisions of Section 7 shall apply. 6.5. Fines. The rejection of checks will generate the legally established fines, as noted below, and will determine the obligation of the entity, according to point 6.4.3., to report them to the BCRA, in accordance with the established operating regime. 6.5.1. Determination of the amount. The rejection for formal defects and for insufficient funds, both of common or deferred payment checks not registered, and the rejection of registration of deferred payment checks, will give rise to a fine equivalent to 4% of the rejected value with a minimum of $100 and a maximum of $50,000. The amount will be reduced to 2% with a minimum of $50 and a maximum of $25,000, when the check subject to the sanction is paid within 30 calendar days from the rejection, a circumstance that must be reliably accredited before the drawee. The amount of the fine generated by the rejection of ECHEQ issued in United States dollars will be converted to pesos applying the reference exchange rate (Communication A 3500) corresponding to the date of its effective payment. 6.5.2. Collection by banks. 6.5.2.1. The amount of the fines will be debited by banking entities –as prescribed by Law 25.730– from the respective accounts. 6.5.2.2. It will be considered that this collection is also configured when the corresponding amount has been debited from the current account generating a debit balance or when payment has been verified by any other freely agreed means. 6.5.2.3. If the debit of the fine cannot be effected due to the respective account being closed and/or if payment has not been made as established in point 6.5.2.2., the account holder will be subject to the situation referred to in point 8.2.2. The banking entity must notify the BCRA of the collection of the corresponding fines, according to the established operating regime. 6.5.3. Collection by the Central Bank of the Argentine Republic. The amount of the fines will be debited from the current account of the entity opened at the BCRA, based on the information it provides regarding the collected fines. B.C.R.A.
