The Prudential Control and Resolution Authority, Having regard to the Monetary and Financial Code, particularly Articles L. 526-2 and L. 612-24; Having regard to the Decree of May 2, 2013 on the Prudential Regulation of Electronic Money Institutions, particularly Article 47; Having regard to the Decree of October 29, 2009 on the Prudential Regulation of Payment Institutions; Having regard to the opinion of the Prudential Affairs Consultative Committee of May 22, 2014, DECIDES
Article 1: This Instruction applies to electronic money institutions as defined in Article L. 526-1 of the Monetary and Financial Code, hereinafter referred to as "subject institutions."
Article 2: When a subject institution wishes to provide, without having previously declared them, the payment services mentioned in point 1° of Article L. 526-2 of the Monetary and Financial Code or the ancillary credit granting service mentioned in point 2° of the same Article, it shall transmit the annex to this Instruction to the General Secretariat of the Prudential Control and Resolution Authority. This communication must be made three months before the commencement of the provision of services.
Article 3: The form and supplementary documents, duly completed and signed, must be sent in electronic format to the Prudential Control and Resolution Authority by uploading them to the portal accessible at the following address: https://acpr-portail.banque-france.fr.
Article 4: This Instruction enters into force upon its publication.
