Instruction No. 2021-I-14 of October 15, 2021 repealing Instruction No. 2017-I-09 of June 15, 2017 on the acceptance procedure for experts in the context of evaluating the realizable value of real estate and shares of non-listed real estate or land companies

The Prudential Control and Resolution Authority (ACPR) issued Instruction No. 2021-I-14 to formally repeal its previous Instruction No. 2017-I-09. This repeal removes the regulatory framework governing the acceptance procedure for experts assessing the realizable value of real estate and shares in non-listed real estate or land companies. The new instruction entered into force the day following its publication in the Official Register of the ACPR.

The Prudential Control and Resolution Authority (ACPR), Having regard to Directive 91/674/EEC of December 19, 1991 concerning the annual accounts and consolidated accounts of insurance undertakings; Having regard to the Insurance Code, particularly Article R. 343-11 thereof; Having regard to the Mutual Insurance Code, particularly Article R. 212-11 thereof; Having regard to the Social Security Code, particularly Article R. 931-11-1 thereof; Having regard to Decree No. 2021-1248 of September 28, 2021 on the valuation of real estate assets of insurance companies, mutual insurance companies, provident institutions, and supplementary occupational retirement benefit schemes; Having regard to Instruction No. 2017-I-09 of June 15, 2017 on the acceptance procedure for experts in the context of evaluating the realizable value of real estate and shares or stock in non-listed real estate or land companies; Having regard to the opinion of the Prudential Affairs Consultative Committee of June 23, 2021, DECIDES

Article 1: Instruction No. 2017-I-09 of the Prudential Control and Resolution Authority is hereby repealed.

Article 2: This instruction shall enter into force the day following its publication in the Official Register of the Prudential Control and Resolution Authority.
