Regulations amending Finansinspektionen’s regulations (FFFS 2013:9) regarding Swedish UCITS (FFFS 2019:4)

Finansinspektionen amended its regulations regarding Swedish UCITS to align the calculation of a fund management company’s own funds with specific European Union prudential standards. The revision mandates that own funds be calculated according to Articles 25–91 of Regulation (EU) No 575/2013 and relevant Swedish capital buffer regulations. These changes were decided on 21 May 2019 and entered into force on 15 June 2019.

Finansinspektionen prescribes pursuant to section 18, point 7 of the Swedish UCITS Ordinance (2013:588) that Chapter 5, section 3 of Finansinspektionen’s regulations (FFFS 2013:9) regarding UCITS shall have the following wording. Chapter 5 Section 3 A fund management company’s own funds shall be calculated in accordance with the items included in the own funds for securities companies in accordance with Articles 25–91 of Regulation (EU) No 575/2013 on prudential requirements for credit institutions and investment firms and Chapter 3, sections 1–3 of Finansinspektionen’s regulations and general guidelines (FFFS 2014:12) regarding prudential requirements and capital buffers.
