Prime Minister's Decision No. 2310 of 2017 on Issuing the Executive Regulation for Investment Law No. 72 of 2017

The Prime Minister of Egypt issued Decision No. 2310 of 2017 to formally enact the Executive Regulation for Investment Law No. 72 of 2017, replacing the previous 2015 executive regulation. This regulation defines the scope of eligible investment activities across industrial, agricultural, and related sectors while establishing operational frameworks for domestic investment projects in special economic zones. It mandates compliance with existing sector-specific laws and repeals all conflicting provisions to streamline investment licensing and regulatory oversight.

Decided:

(Article One) Without prejudice to the provisions of Law No. 7 of 1991 regarding private state property, Law No. 83 of 2002 regarding economic zones of a special nature, Law No. 14 of 2012 on integrated development in the Sinai Peninsula, and Law No. 15 of 2017 on simplifying procedures for granting industrial facility licenses, the provisions of the Executive Regulation for Investment Law No. 72 of 2017 attached to this Decision shall be applied.

(Article Two) Without prejudice to the provisions of Law No. 83 of 2002 regarding economic zones of a special nature, the provisions of the attached Regulation shall apply to investment projects established under the domestic investment system in those zones.

(Article Three) The Executive Regulation for Investment Guarantees and Incentives issued by Prime Minister's Decision No. 1820 of 2015, referred to above, is hereby repealed, and any provision conflicting with the provisions of the attached Regulation is also repealed.

Chapter One

General Provisions

(Section One)

Activities and Fields Subject to the Provisions of the Investment Law

(Article One)

The following investment activities, as listed, are considered activities subject to the provisions of the Investment Law, without prejudice to the controls stipulated in the laws and regulations governing these activities:

First - The Industrial Sector, which includes the following:

  1. Industrial activities that involve transforming materials and raw materials and altering their form by mixing, processing, shaping, or packaging them, and assembling parts and components to produce intermediate or final products. This does not include the manufacturing of tobacco, cigarettes, shisha, hookah tobacco, alcoholic beverages, and spirits of all kinds.
  2. Designing or manufacturing industrial machinery, equipment, and production lines, and managing implementation or restructuring of factories, which includes: (a) Engineering design works for equipment, production lines, and factories. (b) Preparing and manufacturing models and molds for machines and products, and promoting them. (c) Producing equipment and production lines. (d) Implementation management works for industrial projects and service and utility projects of all kinds, and the technical and administrative restructuring of factories.
  3. The cinema industry, including establishing or investing in film studios, production laboratories, screening venues, or operating them, including filming, developing, printing, producing, screening, and distribution.

  1. Integrated industrial development of industrial zones or completing development, marketing, or managing industrial zones, which includes the following: (a) Preparing economic and planning studies for the industrial zone. (b) Preparing economic, engineering, and technological studies for projects. (c) Establishing infrastructure and external utility sources for the industrial zone. (d) Marketing and promoting industrial zone lands to attract capital and projects. (e) Establishing factory buildings in the industrial zone ready for projects. (f) Managing the industrial zone and maintaining its facilities and structures. These activities may be carried out jointly or separately.

Second - The Agriculture, Animal, Poultry, and Fisheries Sector, which includes the following:

  1. Reclamation and cultivation of barren or desert lands, including: (a) Reclaiming and equipping lands with basic utilities to make them suitable for cultivation. (b) Cultivating reclaimed lands. In both cases, it is required that the lands be designated for reclamation and cultivation purposes, and that modern agricultural methods be used for cultivation, not flood irrigation.
  2. Animal, poultry, and fisheries production, including: (a) Rearing all types of animals, whether for breeding, milk production, fattening, or meat. (b) Rearing all types of poultry and birds, whether for breeding, hatching, egg production, fattening, or meat. (c) Rearing camels. (d) Fish farms.
  3. Genetic engineering in plant and animal fields.
