The Prudential Control and Resolution Authority issued Instruction No. 2020-I-11 to update the standard application dossiers for payment institution authorization, simplified authorization, and payment agent declarations. This directive replaces the templates previously established in Instruction No. 2019-I-22 with new versions detailed in the annexes of the current text. The updated requirements for standard and simplified authorizations take effect the day following publication, while the payment agent declaration template becomes applicable on November 1, 2020.
Instruction No. 2020-I-11 amending Instruction No. 2019-I-22 of April 23, 2019 regarding the forms for applications for authorization and simplified authorization of payment institutions, applications for registration as account information service providers, declarations of payment service provider agents and applications for exemption from authorization under the conditions set forth in Articles L. 521-3-1 and L. 525-6-1 of the Monetary and Financial Code
The Prudential Control and Resolution Authority, Having regard to the Monetary and Financial Code, particularly Articles L. 612-2 and L. 612-24; Having regard to the Order of October 29, 2009 concerning the prudential regulation of payment institutions; Having regard to Instruction No. 2019-I-22 of the Prudential Control and Resolution Authority of April 23, 2019 regarding the forms for applications for authorization and simplified authorization of payment institutions, applications for registration as account information service providers, declarations of payment service provider agents, and applications for exemption from authorization under the conditions set forth in Articles L. 521-3-1 and L. 525-6-1 of the Monetary and Financial Code; Having regard to the opinion of the Prudential Affairs Consultative Commission of October 5, 2020, DECIDES
Article 1: The standard application file for obtaining authorization as a payment institution, mentioned in Article 2 of the aforementioned Order of October 29, 2009 and present in Annex 1 of the aforementioned Instruction No. 2019-I-22, is replaced by the standard file appearing in Annex 1 of this Instruction.
Article 2: The standard application file for obtaining simplified authorization as a payment institution, mentioned in Article 2-1 of the aforementioned Order of October 29, 2009 and present in Annex 2 of the aforementioned Instruction No. 2019-I-22, is replaced by the standard file appearing in Annex 2 of this Instruction.
Article 3: The standard declaration file for an agent providing payment services on behalf of a payment service provider, mentioned in Article 36 of the aforementioned Order of October 29, 2009 and present in Annex 4 of the Instruction No. 2019-I-22 aforementioned, is replaced by the standard file appearing in Annex 3 of the present Instruction.
Article 4: Articles 1 and 2 shall enter into application the day following the publication of this Instruction. Article 3 shall enter into application on November 1, 2020.
