Compliance with EBA Guidelines on Recovery Resolution Planning Recovery Capacity (EBA/GL/2023/06)

The Prudential Control and Resolution Authority (ACPR) has declared compliance with the European Banking Authority's guidelines on recovery resolution planning recovery capacity. These guidelines, applicable from January 11, 2024, require credit institutions and investment firms subject to preventive recovery plans to implement all necessary measures to adhere to the standards. The ACPR also expects financing companies with preventive recovery plan obligations to implement these guidelines.

Annex I

OPINION

Compliance with the European Banking Authority (EBA) Guidelines on Recovery Resolution Planning Recovery Capacity

in accordance with Articles 5 and 7 and Annex, Section A, Point 1), of Directive 2014/59/EU, as well as with Chapter 1, Section II, of Commission Delegated Regulation (EU) 2016/1075 (EBA/GL/2023/06)

The Prudential Control and Resolution Authority (ACPR) has declared compliance with the European Banking Authority's (EBA/GL/2023/06) guidelines on recovery resolution planning recovery capacity. The guidelines are attached to this opinion.

These guidelines are applicable from 11 January 2024 to credit institutions and investment firms subject to the submission of a preventive recovery plan, which must do everything in their power to comply with them, in accordance with the provisions of Article 16 of Regulation (EU) No 1093/2010 of the European Parliament and of the Council of 24 November 2010 establishing a European Supervisory Authority (European Banking Authority).

The ACPR expects financing companies that do not fall within the definition of 'financial institutions' referred to in paragraph 1 of Article 4 of Regulation (EU) No 1093/2010 of the European Parliament and of the Council of 24 November 2010 but which have been subject to the obligation to draw up a preventive recovery plan under the provisions of Section II of Article L. 613-34 of the Monetary and Financial Code to implement these guidelines.
