Instruction No. 2020-I-12 of 14 October 2020 amending Instruction No. 2013-I-09 of 12 July 2013 regarding application forms for approval, agent declaration, and notification of freedom of establishment for electronic money institutions

The Prudential Control and Resolution Authority issued Instruction No. 2020-I-12 to amend the regulatory framework governing electronic money institutions. This instruction replaces the standard application file for obtaining approval as an electronic money institution with a new version detailed in the annex. Additionally, it abrogates the standard declaration file for agents providing payment services on behalf of payment service providers.

Instruction No. 2020-I-12 amending Instruction No. 2013-I-09 of 12 July 2013 regarding application forms for approval, agent declaration, as well as notification of freedom of establishment, freedom to provide services, use of an agent, and recourse to a distributor in another Member State of the European Union or in another State party to the Agreement on the European Economic Area for an electronic money institution amended by Instructions No. 2018-I-01 and No. 2018-I-02 of 21 February 2018 and by Instruction No. 2019-I-16 of 23 April 2019

The Prudential Control and Resolution Authority, Having regard to the Monetary and Financial Code, in particular Articles L. 612-2 and L. 612-24; Having regard to the Order of 2 May 2013 concerning the prudential regulation of electronic money institutions; Having regard to the Order of 29 October 2009 concerning the prudential regulation of payment institutions; Having regard to Instruction No. 2013-I-09 of the Prudential Control and Resolution Authority of 12 July 2013 regarding application forms for approval, agent declaration, as well as notification of freedom of establishment, freedom to provide services, use of an agent, and recourse to a distributor in another Member State of the European Union or in another State party to the Agreement on the European Economic Area for an electronic money institution, amended by Instructions No. 2018-I-01 and No. 2018-I-02 of 21 February 2018 and by Instruction No. 2019-I-16 of 23 April 2019; Having regard to the opinion of the Prudential Affairs Advisory Commission of 5 October 2020, DECIDES

Article 1: The standard application file for obtaining approval as an electronic money institution, mentioned in Article 2 of the aforementioned Order of 2 May 2013 and included in Annex 1 of the aforementioned Instruction No. 2013-I-09, is replaced by the standard file set out in the annex to this Instruction.

Article 2: The standard declaration file for an agent providing payment services on behalf of a payment service provider, mentioned in Article 50 of the aforementioned Order of 2 May 2013 and in Article 36 of the aforementioned Order of 29 October 2009 and included in Annex 3 of the aforementioned Instruction No. 2013-I-09, is repealed.

Article 3: This Instruction shall enter into application the day following its publication.
