Circular No. 2: Executive Enforcement Matters

The Palestine Monetary Authority’s Supervision and Inspection Department issued Circular No. (2019/2) on January 3, 2019, to notify all lending institutions in Palestine of revised procedures for registering executive enforcement lawsuits. Citing a Supreme Court directive dated December 13, 2018, the circular mandates that institutions may now file these cases with execution departments in full compliance with established legal protocols. This new registration pathway is explicitly contingent upon the prior settlement and clearance of all outstanding enforcement files.

Subject: Executive Enforcement Matters

Further to Circular No. (2018/85) regarding the registration of executive enforcement matters in courts, we attach for your information the letter from His Excellency the President of the Supreme Court / President of the Higher Judiciary Council No. (5189/19) dated 13/12/2018, concerning the permission to register executive enforcement lawsuits with the execution departments in accordance with procedures and the law, following the settlement of previous concluded cases.
