Circular Letter No. 4040 — Amends Circular Letter No. 3,967 of August 2, 2019, Establishing Procedures for Remitting Information on Investment Fund Unitholders Due to the Impacts of Covid-19 on the Economy

The Head of the Department of Financial System Monitoring (Desig) of the Central Bank of Brazil issued Circular Letter No. 4040 to amend Circular Letter No. 3,967 of August 2, 2019. This amendment mandates that administrators of investment funds and financial institutions acting as distributors remit information regarding unitholders monthly, as specified in Circular No. 3,945 of June 12, 2019. The regulation enters into force on the date of its publication.

The Head of the Department of Financial System Monitoring (Desig), in exercise of the authority conferred by Article 23, item I, subparagraph "a", of the Internal Regulations of the Central Bank of Brazil, annexed to Ordinance No. 84,287 of February 27, 2015, based on Article 77, items III and IV, of the aforementioned Regulations, and considering the provisions of Circular Letter No. 3,945 of June 12, 2019,

RESOLVES:

Article 1. Circular Letter No. 3,967 of August 2, 2019, shall enter into force with the following alteration:

“Article 1. The remittance of the information referred to in Article 1 of Circular Letter No. 3,945 of 2019 must be carried out monthly by the administrators of investment funds and by financial institutions that act, in the form regulated by the Securities and Exchange Commission (CVM), as distributors of fund units on behalf and in the name of clients, through the following documents:
