The Danish Ministry of Employment issued this order to establish a cancer registry within the Labour Market Insurance system by automatically transferring patient data from the National Pathology Register and the National Patient Register. The registry specifically tracks mesothelioma and cancers of the nose and sinuses using defined ICD-10 and SNOMED codes to identify potential occupational diseases. This regulation, effective January 1, 2024, allows for digital data sharing without patient consent and replaces the previous 2016 order while maintaining existing reporting obligations for physicians.
Order on Notification to the Labour Market Insurance of Certain Cancers That May Be Occupational
Pursuant to Section 34, Paragraph 2, of the Act on Work Accident Insurance, cf. Act Consolidation No. 1186 of 19 August 2022, it is hereby stipulated:
The Labour Market Insurance Cancer Registry
Section 1. The Labour Market Insurance Cancer Registry is formed from information from the National Pathology Register and the National Patient Register regarding patients who have been diagnosed with one of the diagnoses mentioned in Section 2, Paragraph 1. The diagnosis must appear in the National Pathology Register and/or the National Patient Register.
Paragraph 2. The National Pathology Register and the National Patient Register are maintained by the Danish Health Data Authority.
Diagnoses
Section 2. The following diagnoses form the basis for the Labour Market Insurance Cancer Registry:
Paragraph 2. The diagnosis in Paragraph 1, No. 1, includes persons who are listed in the National Pathology Register with tissue type codes (histology codes) M 9050-9059 (SNOMED) and with code 3 for tumor behavior (malignant growth), and/or persons who are listed in the National Patient Register with at least one of the following ICD-10 codes: C45.0, C45.1, C45.2, C45.7, C45.9.
Paragraph 3. The diagnosis in Paragraph 1, No. 2, includes persons who are listed in the National Pathology Register with localization codes (topography codes) T 21000-22010 (SNOMED) and with code 3 for tumor behavior (malignant growth), and/or persons who are listed in the National Patient Register with at least one of the following ICD-10 codes: C30.0, C31.0, C31.1, C31.2, C31.3, C31.8, C31.9.
Notification to the Labour Market Insurance
Section 3. The Labour Market Insurance receives notification from the Danish Health Data Authority regarding the patient's CPR number and status (alive/dead), diagnosis, and the diagnosing hospital and department, from the registers mentioned in Section 1, Paragraph 2.
Paragraph 2. The Labour Market Insurance receives the information digitally and without consent from the person to whom the notification relates.
Section 4. The obligation of doctors and dentists to report pursuant to Section 34, Paragraph 1, of the Work Accident Insurance Act does not cease as a result of notification under this Order.
Section 5. This Order enters into force on 1 January 2024 and applies to data received in the registers mentioned in Section 1, Paragraph 2, at the Danish Health Data Authority on the date of entry into force or later.
Paragraph 2. Order No. 1482 of 2 December 2016 on notification to the Labour Market Insurance of certain cancers that may be occupational is repealed.
