Declaration of Compliance with the European Banking Authority Guidelines Complementing the Resolution Assessment for Banks with a Transfer Strategy (EBA/GL/2022/11)
The French Prudential Supervision and Resolution Authority formally declares compliance with the European Banking Authority guidelines (EBA/GL/2022/11) that supplement resolution assessments for banks employing transfer strategies. These guidelines establish clear expectations for resolution authorities and institutions regarding the definition of transfer perimeters, the assessment of their separability from the broader entity, and the operational preparation required to execute transfers. The document confirms that these requirements apply to all financial institutions and competent authorities as defined in Regulation (EU) No 1093/2010.

Declaration of Compliance with the European Banking Authority Guidelines Complementing the Resolution Assessment for Banks with a Transfer Strategy (EBA/GL/2022/11)
The Prudential Supervision and Resolution Authority declares itself compliant with the European Banking Authority guidelines (EBA/GL/2022/11), intended to complement the resolution assessment for banks whose resolution strategy includes a transfer tool.
These new guidelines complement the European Banking Authority's guidelines on resolution (EBA/GL/2022/1) published on 13 January 2022 and aim, in particular, to assess the feasibility and credibility of transfer strategies. Their main purpose is to clarify to resolution authorities and institutions the key expectations regarding the definition of the transfer perimeter, the assessment of the separability of the transfer perimeter from the rest of the institution, and the preparation of operational processes for the execution of the transfer.
These guidelines apply to financial institutions within the meaning of Article 4(1) of Regulation (EU) No 1093/2010 and to competent authorities within the meaning of point (v) of Article 4(2) of Regulation (EU) No 1093/2010.
