On Amending the Licensing and Registration Regulation Series 2000

The Capital Market Authority and the Governor of the Central Bank of Lebanon issued Notice No. 85 to amend the Licensing and Registration Regulation Series 2000 under Law No. 161. The amendment adds a mandatory sanctions-screening requirement to Article 2205, ensuring that shareholders, beneficial owners, directors, and senior executives involved in financial instruments are not listed on local or international sanctions lists. It also updates Annex 2 to specify acceptable identity and commercial registration documentation for founders and executives, with the notice taking immediate effect upon publication in the Official Gazette.

Notice No. 85

Regarding the Amendment of the Licensing and Registration Regulation Series 2000 under Law No. 161 dated 2011/8/17 concerning Financial Markets, as follows:

The Authority hereby informs you:

First: Item (8) is added to Article 2205 of the Licensing and Registration Regulation Series 2000, becoming as follows:

-8 Shareholders The Authority ensures that shareholders, beneficial owners, directors, and senior executive management members who will participate in activities related to financial instruments are not listed on any local or international sanctions lists.

Second: Item 1 of Annex 2 attached to the Licensing and Registration Regulation Series 2000, titled "Founders and Executives", is amended to become as follows:

-1 Founders and Executives A document confirming the identity of founding members, persons participating in subscribing to the company’s capital, beneficial owners, and persons holding positions in management and senior executive management of the company. (This may include a personal registration form, identity card, or passport, or a commercial registry certificate if the applicant is a legal entity.)

Third: This notice takes effect upon its publication in the Official Gazette.
