Procedures for Implementing Levies in the Financial Services Sector and Other Revenues

The Financial Services Authority (OJK) issued POJK No. 2 of 2025 to operationalize the management of non-tax state revenues derived from levies and other receipts under Government Regulation No. 41 of 2024. This regulation establishes detailed procedures for direct levy collection, annual cost verification, debt categorization, payment obligation adjustments, and the imposition of administrative sanctions. It simultaneously repeals previous OJK regulations regarding levy implementation procedures to ensure uniformity and clarity for taxpayers.

Regulation of the Financial Services Authority Number 2 of 2025 Concerning Procedures for Implementing Levies in the Financial Services Sector and Other Revenues

Abstract: This Regulation of the Financial Services Authority is drafted in the framework of implementing Government Regulation Number 41 of 2024 concerning the Work Plan and Budget of the Financial Services Authority and Levies in the Financial Services Sector, to provide clarity regarding the management of non-tax state revenues originating from Levies and other receipts using the mechanism of partners of agencies managing non-tax state revenues. The legal basis for this Regulation of the Financial Services Authority (POJK) is: Law Number 21 of 2011 as amended by Law Number 4 of 2023; and Government Regulation Number 41 of 2024. This Regulation of the Financial Services Authority regulates more operational provisions, including procedures such as using Levies and other receipts directly, conducting verification of annual cost calculations, receiving deposits of Levies and other receipts, categorizing bad debts and conducting settlement, adjusting levy payment obligations with the Minister's approval, and imposing administrative sanctions. Furthermore, specific explanations are required to further clarify the intent of certain articles or paragraphs in the aforementioned Government Regulation so that they are not interpreted otherwise, thereby creating uniformity and clarity in implementation, especially by Taxpayers.

Note: This Regulation of the Financial Services Authority takes effect on the date of promulgation. This Regulation of the Financial Services Authority was promulgated on February 12, 2025, and established on February 3, 2025. Provisions regarding Levies and other receipts in this Regulation of the Financial Services Authority take effect on January 1, 2025. Collection of Levies and imposition of administrative sanctions are implemented against levy and other receipt payment obligations starting from January 1, 2025. Upon the entry into force of this Regulation of the Financial Services Authority: a. Regulation of the Financial Services Authority Number 3/POJK.02/2014 concerning Procedures for Implementing Levies by the Financial Services Authority; and b. Regulation of the Financial Services Authority Number 22/POJK.02/2018 concerning Amendments to Regulation of the Financial Services Authority Number 3/POJK.02/2014 concerning Procedures for Implementing Levies by the Financial Services Authority, are repealed and declared invalid.
