Amendment to the Schedule of the Anti-Money Laundering Act, 2010

This notification updates the Schedule of the Anti-Money Laundering Act, 2010 by adding specific offenses to the list of predicate offenses. The amendments incorporate new provisions under the Pakistan Penal Code, the Prevention of Corruption Act, 1947, and the Foreign Exchange Regulation Act, 1947. Furthermore, it revises the existing entries related to The Customs Act, 1969 to better align with anti-money laundering enforcement requirements.

MINISTRY OF FINANCE

NOTIFICATION

Islamabad, the 1st April, 2015

S. R. O. 279(I)/2015.—In exercise of the powers conferred by section 42 of the Anti Money Laundering Act, 2010 (VII of 2010), the Federal Government is pleased to direct that the following further amendments shall be made in the Schedule to the aforesaid Act, namely:—

In the aforesaid Schedule,—

(a) in Section-I, under the heading “the Pakistan Penal Code, 1860 (Act XLV of 1860)”,—

(i) after the entry relating to “417” the following new entry shall be inserted, namely:—

“419 Punishment for cheating by personation.”; and

(ii) after the entry relating to “489E” the following new entry shall be inserted, namely:—

“489G Counterfeiting or using documents resembling Prize Bonds or unauthorized sale thereof.”;

(b) after Section-III, the following new Section shall be inserted, namely:—

“Section IIIA Prevention of Corruption Act, 1947 (II of 1947)

5 Criminal misconduct.

5B Declaration of Assets.

5C Possession of Property disproportionate to known sources of income.

Section IIIB Foreign Exchange Regulation Act, 1947 (VII of 1947) Sub-section (1) of section 4 read with section 23.

Section 5 read with section 23.”; and

(c) in Section VI, under the heading “The Customs Act, 1969 (IV of 1969)” for the existing entries the following shall be substituted, namely:—

“(a) Section 2(s) read with clause 8, 89 of section 156(1)

(b) Section 15 read with clause 8, 9, 89 & 90 of section 156(1)

(c) Section 16 read with clause 8, 9, 89 & 90 of section 156(1)

(d) Section 32 read with clause 14 of section 156(1)

(e) Section 32A read with clause 14A of section 156(1)

(f) Section 139 read with clause 70 of section 156(1).”
