Instruction No. 2024-I-16 of 17 December 2024 on the withdrawal of approval, authorization or registration of financing companies, third-party financing companies, investment firms, payment institutions, account information service providers, electronic money institutions, credit managers or token issuers referring to one or more assets

The Prudential Control and Resolution Authority (ACPR) issued Instruction No. 2024-I-16 to standardize the procedures for the withdrawal of approvals, authorizations, or registrations for various financial entities including financing companies, investment firms, and crypto-asset service providers. The instruction mandates that these entities complete and submit a specific electronic form via the ACPR portal to request the withdrawal of their status. This document replaces Instructions No. 2024-I-05 and No. 2024-I-09 by correcting material errors and enters into force on 20 January 2025.

Instruction No. 2024-I-16 on the withdrawal of approval, authorization or registration of financing companies, third-party financing companies, investment firms, payment institutions, account information service providers, electronic money institutions, credit managers or token issuers referring to one or more assets replacing Instruction No. 2024-I-05 and Instruction No. 2024-I-09

The Prudential Control and Resolution Authority (ACPR), Having regard to Regulation (EU) 2023/1114 of the European Parliament and of the Council of 31 May 2023 on markets in crypto-assets, in particular Article 24 thereof; Having regard to the Monetary and Financial Code, in particular Articles L. 511-15-1, L. 522-11, L. 522-11-3, L. 526-14 et seq., L. 532-6, L. 553-1, L. 54-11-5, R. 518-71-II; Having regard to the Order of 29 October 2009 on the prudential regulation of payment institutions; Having regard to the Order of 2 May 2013 on the prudential regulation of electronic money institutions; Having regard to the Order of 4 December 2017 on the approval, modification of status, withdrawal of approval and deregistration of investment firms and similar institutions; Having regard to the Order of 4 December 2017 on the approval, modification of status, withdrawal of approval and deregistration of financing companies, as well as on the reporting obligations of certain financial institutions; Having regard to the opinion of the Prudential Affairs Consultative Committee of 27 November 2024, DECIDES

Article 1: This Instruction applies to the following companies, institutions and bodies: 1° Financing companies referred to in paragraph II of Article L. 511-1 of the Monetary and Financial Code; 2° Third-party financing companies referred to in point 8 of Article L. 511-6 of the same Code; 3° Investment firms referred to in Article L. 531-4 of the same Code; 4° Payment institutions referred to in paragraph I of Article L. 522-1 of the same Code; 5° Account information service providers referred to in paragraph II of Article L. 522-1 of the same Code; 6° Electronic money institutions referred to in Article L. 526-1 of the same Code; 7° Credit managers referred to in point 4 of Article L. 54-11-1 of the same Code; 8° Token issuers referring to one or more assets referred to in Article L. 553-1 of the same Code.

Article 2: The companies, institutions and bodies referred to in Article 1 that request the withdrawal of their approval, authorization or registration must complete a form following the model set out in the annex to this Instruction.

Article 3: The form and any supplementary documents, duly completed and signed, must be sent in electronic format to the ACPR by uploading them to the ACPR portal at the following address: https://acpr-portail.banque-france.fr

Article 4: This Instruction replaces Instructions No. 2024-I-05 and No. 2024-I-09, correcting material errors therein. References to Instructions No. 2024-I-05 and No. 2024-I-09 contained in other Instructions shall be understood as references to this Instruction.

Article 5: This Instruction is published in the official register of the Prudential Control and Resolution Authority and enters into force on 20 January 2025.
