CMN Resolution No. 5,303 — Amends Rules on Social, Environmental, and Climatic Impediments in the Rural Credit Manual

CMN RESOLUTION NO. 5,303, OF MAY 12, 2026

Amends rules of Section 9 (Social, Environmental, and Climatic Impediments) of Chapter 2 (Basic Conditions) of the Rural Credit Manual – MCR.

The Central Bank of Brazil, in accordance with Art. 9 of Law No. 4,595, of December 31, 1964, makes public that the National Monetary Council, in an extraordinary session held on May 12, 2026, based on Art. 4, caput, item VI, of Law No. 4,595, of December 31, 1964, and Arts. 4 and 14 of Law No. 4,829, of November 5, 1965,

RESOLVES:

Art. 1 The Section 9 (Social, Environmental, and Climatic Impediments) of Chapter 2 (Basic Conditions) of the Rural Credit Manual – MCR shall enter into force with the following alterations:

“17 - The financial institution must verify whether there has been suppression of native vegetation after July 31, 2019, on the rural property where the undertaking will be conducted, through consultation with the list made available by the Ministry of Environment and Climate Change, based on the database of the Program for Monitoring Brazilian Biomes – BiomasBR, which uses data from the Project for Monitoring Deforestation in Legal Amazon by Satellite – Prodes, of the National Institute for Space Research – Inpe, observing that this requirement will begin in:

a) January 4, 2027, when it concerns rural properties with an area greater than fifteen fiscal modules;

b) July 1, 2027, when it concerns properties with an area greater than four and up to fifteen fiscal modules; and

c) January 3, 2028, when it concerns rural properties with an area of up to four fiscal modules.” (NR)

“17-A - For properties occupied by agrarian reform settlements and by traditional peoples and communities, in cases where the CAR refers to the perimeter of the collective use property, the deadline provided for in item 17, item “c”, applies.” (NR)

a) Authorization for Vegetation Suppression – ASV issued in accordance with the provisions of CONAMA Resolution No. 510, of September 15, 2025, Authorization for Alternative Land Use – UAS or another administrative act equivalent to the suppression authorization issued by the competent environmental agency in accordance with Art. 26 of Law No. 12,651, of May 25, 2012, observing that:

I - in the case of UAS or equivalent act, only documents issued prior to March 15, 2026, the date of entry into force of CONAMA Resolution No. 510, of September 15, 2025, will be accepted; and

II - an ASV issued prior to September 15, 2025, may be accepted;

e) Environmental Commitment Term signed with the competent state environmental agency, for the purpose of regularizing the property with suppression of native vegetation occurring after July 31, 2019, in accordance with Art. 79-A of Law No. 9,605, of February 12, 1998.” (NR)
