Notice No. 6 of 2022, dated March 3, on Foreign Exchange Policy: Entry and Exit of Currency

The National Bank of Angola issued Notice No. 6 of 2022 to update foreign exchange regulations governing the cross-border transport of cash and bearer payment instruments. The notice mandates a USD 10,000 declaration threshold for all travelers entering the country and establishes corresponding exit limits of USD 10,000 for residents (reduced to USD 1,000 for unaccompanied minors under 18) and foreign currency equal to entry value for non-residents. Border authorities may restrict currency movements based on criminal suspicion, with non-compliance subject to penal sanctions and all interpretative matters resolved by the National Bank of Angola.

  • Entry and Exit of Currency

Considering the evolution of various national and international laws and regulations regarding the foreign exchange market, as well as the prevention and combating of money laundering and terrorist financing, which impact the transport of cash in the form of currency or bearer payment instruments between countries, it is necessary to update the current regulations on the entry and exit of currency.

In accordance with the provisions of paragraph 2 of Article 28 of Law No. 5/97, dated June 27 (Foreign Exchange Law), combined with Article 39 and paragraph 1 of Article 54, both of Law No. 24/21, dated October 18 (National Bank of Angola Law).

DETERMINE: Article 1. (Object and Scope) This Notice aims to define: a) The limit for the exit of cash or bearer payment instruments (hereinafter collectively referred to as "currency") applicable to individuals, whether resident or non-resident for foreign exchange purposes, who cross the country's borders; b) The situations that require travelers to complete a declaration form for the entry of currency into the country.

  1. For the purposes of this Notice, foreign exchange residents are considered to be individuals who meet the requirements set forth in Article 4 of Law No. 05/97, dated June 27 (Foreign Exchange Law), namely: a) Individuals who have their habitual residence in the country; b) National citizens who are diplomats, consular representatives or equivalent personnel serving abroad, as well as members of their families; c) Individuals whose absence abroad, for a period exceeding 90 (ninety) days and less than 01 (one) year, originates from study purposes or is determined by the exercise of public functions; d) All foreign citizens residing in Angola and holding a residence card.

  2. For the purposes of this Notice, foreign exchange non-residents are considered to be: a) Individuals with habitual residence abroad; b) National citizens who emigrate, as well as those who leave the national territory for a period exceeding one year; c) Diplomats, consular representatives or equivalent personnel serving within the national territory, as well as members of their families.

  1. Individuals, whether foreign exchange residents or non-residents, who transport into the country national or foreign currency with a total value equal to or greater than USD 10,000.00 (ten thousand United States dollars) must, upon entry, declare these values by completing a declaration form provided by the customs services.

The declaration form available at the customs services upon entry into the country must be completed and signed by the traveler and submitted to said services, which validate the information on the form, retain the original and deliver a duplicate to the traveler.

Article 4. (Exit of Currency)

  1. Foreign exchange resident individuals may transport out of the country national and/or foreign currency up to a total value equivalent to USD 10,000.00 (ten thousand United States dollars), with the exception referred to in the following paragraph.

  2. Foreign exchange resident individuals under 18 years of age, traveling unaccompanied, may transport out of the country national or foreign currency up to a total value equivalent to USD 1,000.00 (one thousand United States dollars).

  3. Foreign exchange non-resident individuals may transport out of the country foreign currency in a value equal to the currency with which they entered the country.

  4. The transport out of the country, under the preceding paragraph, of currency in a value equal to or greater than USD 10,000.00 (ten thousand United States dollars), is subject to proof of entry of this value into the country, through the submission of the duplicate of the currency declaration form to the customs services upon exit.

Article 5. (Intervention of Border Authorities) Border authorities, within the scope of their competencies, may condition the exit of national or foreign currency, regardless of whether the values comply with the limits regulated in this Notice, whenever suspicion arises regarding any criminal offense against the traveler transporting the currency, in accordance with current legislation.

CONTINUATION OF NOTICE NO. 06/2022 Page 4 of 4 Article 6. (Sanctions) Non-compliance with the provisions of this Notice constitutes an offense punishable under the penal code and complementary legislation.

Article 7. (Revocation) Notice No. 01/16, dated April 12, and all regulations contrary to the provisions of this Notice are revoked.

Article 8. (Doubts and Omissions) Doubts and omissions resulting from the interpretation and application of this Notice are resolved by the National Bank of Angola.

Article 9. (Entry into Force) This Notice enters into force 30 days after the date of its publication.
