Regulations amending Finansinspektionen’s regulations regarding occupational pension undertakings (FFFS 2024:32)

Finansinspektionen issued regulations amending its guidelines on occupational pension undertakings to exclude specific ICT service outsourcing agreements from certain provisions. The amendment inserts a new section stating that sections 69–71 do not apply to outsourcing covered by the EU Digital Operational Resilience Act. These regulations entered into force on 17 January 2025.

Only the printed version of the regulation in Swedish applies for the application of the law. 1 Regulations amending Finansinspektionen’s regulations and general guidelines (FFFS 2019:21) regarding occupational pension undertakings; decided on 18 December 2024. Finansinspektionen prescribes pursuant to Chapter 5, section 2, point 27 of the Occupational Pension Undertakings Ordinance (2019:809) that a new section, Chapter 8, section 2a, shall be inserted into Finansinspektionen’s regulations and general guidelines (FFFS 2019:21) regarding occupational pension undertakings with the following wording. Chapter 8 Section 2a That set out in sections 69–71 does not apply to outsourcing agreements for ICT services covered by Chapter V of Regulation (EU) 2022/2554 of the European Parliament and of the Council of 14 December 2022 on digital operational resilience for the financial sector and amending Regulations (EC) No 1060/2009, (EU) No 648/2012, (EU) No 600/2014, (EU) No 909/2014 and (EU) 2016/1011.
