The Czech National Bank amends reporting regulations for pension companies to introduce a new risk assessment report and update portfolio composition reporting requirements. The decree mandates that all reports be submitted electronically via the Bank's secure interface using recognized electronic signatures. These changes, which also remove obsolete references to commercial register digitization, enter into force on January 1, 2021.
404 DECREE of 1 October 2020, amending Decree No. 425/2012 Coll., on the submission of information by a pension company to the Czech National Bank, as amended by Decree No. 476/2017 Coll.
The Czech National Bank, pursuant to Section 170(1) of Act No. 427/2011 Coll., on supplementary pension savings, as amended by Act No. 119/2020 Coll., implementing Section 119(4), and pursuant to Section 41(3) of Act No. 6/1993 Coll., on the Czech National Bank, as amended by Act No. 227/2013 Sb., hereby decrees:
Article I
Decree No. 425/2012 Coll., on the submission of information by a pension company to the Czech National Bank, as amended by Decree No. 476/2017 Coll., is amended as follows:
In Section 2, at the end of letter b), a comma is replaced by a full stop, and letter c) is repealed.
In Section 3(1)(b), at the end of point 2, the word "and" is replaced by a comma.
In Section 3(1), at the end of letter b), a full stop is replaced by the word "and", and point 4 is added, which reads: "4. PSP (CNB) 34-12 'Report on the composition of the portfolio of a pension company/fund',".
In Section 3, at the end of paragraph 1, letter c) is added, which reads: "c) as of the last day of the calendar year and submitted within 30 days after the end of the calendar year to which it relates, the report PSP (CNB) 40-01 'Supplementary information for the assessment of the riskiness of a pension company'.".
In Section 3(2)(c), the words "managed fund" are replaced by the words "pension company/fund".
In Section 5(1), first sentence, the words "prescribed by the legal regulation on the digitalization of the commercial register3)" including footnote no. 3 are repealed.
Footnote no. 4 is repealed, including the reference to the footnote.
Section 6, including the heading, reads: "Section 6 Method and form of submitting reports (1) A pension company submits to the Czech National Bank the reports referred to in Section 3 in electronic form as data messages in the format and structure of data files. (2) Data messages referred to in paragraph 1 are transmitted using means enabling remote access via the internet application or user interface of the Czech National Bank's collection system. (3) A data message referred to in paragraph 1 is signed by the pension company with a recognized electronic signature of the contact person. (4) A pension company informs the Czech National Bank of the name, office address, telephone number, and email address of the contact person. The pension company shall inform the Czech National Bank without undue delay of any changes to these details.".
Section 8, including the heading, is repealed.
In the Annex, in the first and second paragraphs, the second sentence is repealed.
In the Annex, in the fourth paragraph, in the heading, the words "managed fund" are replaced by the words "pension company/fund", after the words "in the portfolio" the words "of the pension company and" are inserted, after the words "investment limits" the words "relating to the managed fund" are inserted, and after the words "to assets" the words "of the pension company/" are inserted.
At the end of the Annex, a paragraph is added, which reads: "PSP (CNB) 40-01 'Supplementary information for the assessment of the riskiness of a pension company' The report contains supplementary information on the risk profile of the pension company and the funds it manages, information on dividends paid or planned, and on funds received and paid out by the pension company, broken down by the year of birth of participants in pension savings and supplementary pension savings in intervals of 5 years.".
Article II
Entry into force
This decree shall enter into force on 1 January 2021.
